<br /> 128 <br />Regular Meeting January 23, 1995 Page 3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> AMENDING ARTICLE V, CODE OF ETHICS, OF CHAPTER 2, <br /> ADMINISTRATION, OF THE SAN MARCOS CODE OF ORDINANCES TO <br /> ELIMINATE DUPLICATIONS OF STATE LAWS; PROVIDING FOR <br /> SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A <br /> PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE <br /> DATE. <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Cox seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, UPDATING ARTICLES I AND II OF CHAPTER 30, WATER AND <br /> SEWERS AND SEWAGE DISPOSAL OF THE SAN MARCOS CODE OF ORDINANCES <br /> REGARDING WATER AND SEWER TAP FEES, MISCELLANEOUS SERVICE FEES <br /> AND WATER AND SEWER SYSTEM IMPACT FEES; SETTING THE AMOUNTS OF <br /> CERTAIN FEES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br /> PENALTIES FOR VIOLATIONS. <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Mooney seconded the motion. The water and sewer tap fees are <br />presently $250.00 each and Staff recommends they be changed to <br />$500.00 each to cover the city's actual costs. These fees would be <br />in line with surrounding cities. If there is no gravity flow, <br />citizens could opt to add a lift station, but it is not required. <br />Mark Brinkley advised there are a couple of recent exceptions in the <br />City where septic tanks have been allowed, and both sites are in <br />excess of an acre. Mr. Gilley stated the City could prohibit the <br />use of septic tanks if we make lines available to everyone. Mr. <br />Hart requested Staff see if it would be possible for water, <br />wastewater and electric utility deposits to be transferred to a new <br />address by automation rather than making deposit payments for the <br />new address (Mr. Guerra present at this time - 8:l3 p.m.). On roll <br />call the following vote was recorded: <br /> AYE: Moore, Mooney, Hart, Morris, Cox, Hernandez. <br /> NAY: None. <br />ABSTAIN: Guerra. <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE TRAFFIC REGISTER TO ADD A TWO HOUR PARKING <br /> LIMIT IN THE 400 BLOCK OF NORTH LYNDON B. JOHNSON DRIVE; <br /> PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br /> ORDINANCES; PROVIDING FOR PUBLICATION; AND PROVIDING AN <br /> EFFECTIVE DATE. <br />Mr. Cox moved for approval of the Ordinance on second reading and <br />Mr. Moore seconded the motion. Mr. Hart moved to amend the <br />Ordinance caption to correct the block in question to read "400" <br />instead of 900 and Mr. Mooney seconded the motion, which passed <br />unanimously. The Council then voted unanimously for approval of the <br />Ordinance on second reading. <br />Mayor Morris introduced for consideration approval of the minutes of <br />the Special Meeting held December 19, 1994 and Regular Meeting held <br />January 9, 1995, approval of seven Ordinances on second reading, <br />adoption of two Ordinances on third and final reading, and adoption <br />of thirteen Resolutions on consensus. The Council removed Items <br />lO.B. (4), approval of an Ordinance on second reading, Items lO.C. (l) <br />and 10. C. (2), adoption of Ordinances on third and final reading, <br />Items 10. D. (3), lO.D. (6), 10.D. (9) and lO.D. (lO), adoption of <br />Resolutions, to be considered separately.
