(1) Mr. Taylor <br /> reported to the Council he has researched and found our <br /> extraterritorial jurisdiction abutts Martindale's and goes as far as <br /> we are permitted. If we do a strip annexation of 1,000 feet with <br /> 500 feet on each side of the river, that would be 370 acres with a <br /> tax base of $l,100,000.00 the City could add to the tax roll. We <br /> would also have the necessity of providing police and fire <br /> protection to that area and would not have easy access to this <br /> property. He stated it would be difficult to project the costs for <br /> this. The citizens Advisory Committee will recommend in the Master <br /> Plan process the City pursue annexing the property. The City's <br /> primary concern in considering annexation of this land would be <br /> protection of the San Marcos River. Mayor Morris stated she would <br /> contact the Mayor of Martindale to see if they would be willing to <br /> put in place zoning and a River Corridor Ordinance, and the city <br /> should also contact Guadalupe County regarding protection for the <br /> portion along the river in that County. (2) Mr. Taylor stated he <br /> has researched the change in Federal Law which deals with wrecker <br /> services and has ascertained it does not impact the city's Wrecker <br /> Ordinance dealing with the wrecker rotation service used by the <br /> Police Department. <br /> Mayor Morris introduced the city Council's Report. . (l) The Council <br /> directed Mr. Gilley set up a date for the City Council's quarterly <br /> Workshop. (2) Mayor Morris reminded the Council to bring any <br /> issues that need to be addressed in the legislative agenda to Larry, <br /> Melissa or the Mayor. (3) Mayor Morris stated the Council would be <br /> making appointments to the CTHEA Board at the next meeting, and <br /> CTHEA has requested a member be reappointed under special provision <br /> allowed in City Ordinance to retain continuity on the Board. (4) <br /> The Council gave Mr. Gilley direction to proceed with two lanes, and <br /> four lanes if possible, on the Chisos Drive request. They also <br /> asked how this could be funded. (5) The Incubator Board has <br /> requested the city Council hold a Workshop, and Mayor Morris <br /> scheduled the Workshop for Monday, February l3, 1995 from 5:30-6:30 <br /> p.m. (6) Mayor Morris stated the Confederate Air Force needs <br /> funding for roof repair in this fiscal year budget. (7) Mr. Cobb <br /> advised the Council no Texas City has a public owned mausoleum in <br /> their cemetery. Private firms charge between $3l5.00-$565.00 for <br /> mausoleums with perpetual care. This cost is controlled by <br /> legislation. The city charges $330.00 and $360.00 for mausoleums <br /> and could charge up to $90.00 for perpetual care. The Council <br /> directed Staff bring Council recommendations. (8) Mr. Cox asked <br /> what the city's policy is on repairing sidewalks, as he knows of an <br /> area in the downtown area in need of repair. He is to discuss the <br /> specific location with Mr. Gilley. (9) Mr. Cox stated the Master <br /> Plan Committee will meet on February 16. <br /> Mayor Morris introduced an Executive Session pursuant to the <br /> Government Code, section 551.07l, to discuss pending litigation <br /> (Sierra Club vs. Babbitt; San Marcos Joint Venture vs. City of San <br /> Marcos), and matters where the city Attorney's ethical duty to <br /> the City clearly conflicts with Government Code Chapter 551. Mr. <br /> Moore moved to adjourn into Executive Session at lO:l2 p.m. and Mr. <br /> Mooney seconded the motion, which passed unanimously. <br /> Mr. Guerra moved the Council reconvene at 11:57 p.m. and Mr. Moore <br /> seconded the motion, which passed unanimously. <br /> The meeting adjourned at 11:58 p.m. on motion made by Mr. Mooney and <br /> seconded by Mr. Moore.
