notification relieve the responsible person of an fine, ine, penalty, <br />other liability which may be iMposed pursuant to this Division or <br />to state or federal law. <br />(5) Any person responsible for any release as described in subsection <br />(c)(1) above shall comply with all state, federal, and any other <br />local law requiring reporting, cleanup, containment, and any other <br />appropriate remedial action in response to the release. <br />(6) Failure to report a known release may result in fines as described <br />in Section 86.535. <br />(7) Any person responsible for a release described in subsection (c)(1) <br />above shall reimburse the City of San Marcos for any cost incurred <br />by the City in responding to the release. <br />Sec. 86.528. Coal Tar Pavement Products. <br />(a) Coal Tar Pavement Products Prohibited. <br />(1) A person may not apply a coal tar pavement product within the <br />City Limits except as provided for in subsection (c). <br />(2) A person who owns property on which a coal tar pavement product <br />is applied after the effective date of this Division is in violation of <br />this section. <br />(b) Sale of Coal Tar Pavement Products Restricted. <br />(1) A person may not sell a coal tar pavement product within the City <br />Limits, unless; <br />a. The sale is to a person who intends to use the coal tar <br />pavement product outside of the City Limits; and <br />b. The seller requires the purchaser to complete and sign a <br />form provided by the City that includes: <br />1. The name, address, and phone number of the <br />purchaser, <br />2. The date of the purchase <br />3. A statement that the coal tar pavement product will <br />not be used within the City Limits; and <br />
