construction activity. In addition, the SWPPP shall be amended to <br />identify any new contractor and/or subcontractor that will <br />implement a measure in the SWPPP. <br />(10) Qualified personnel, provided by the operator of the construction <br />site, shall inspect disturbed areas of the construction site that have <br />not been finally stabilized, areas used for storage of materials that <br />are exposed to precipitation, structural control measures, and <br />locations where vehicles enter or exit the site, at least once every <br />seven (7) calendar days. The inspection must occur on a <br />specifically defined day, regardless of whether or not there has <br />been a rainfall event since the previous inspection. <br />Based on the results of the inspections reauired by subsection <br />(c)(10), the site description and/or the pollution prevention <br />measures identified in the SWPPP shall be revised as appropriate, <br />but in no case later than seven (7) calendar days following <br />inspection. Required modifications shall be implemented within <br />seven (7) calendar days following the he inspection. <br />(12) The operator shall retain copies of any SWPPP and all reports <br />required by this Division or by the TPDES permit for the site, and <br />records of all data used to complete the NOI, for a period of at <br />least three (3) years from the date that the site is finally stabilized. <br />(13) Where a site has been finally stabilized (refer to the definition of <br />final stabilization in Section 86.523) and all stormwater discharges <br />from construction activities that are authorized by this Division <br />and by the TPDES permit for those construction activities are <br />eliminated, or where the operator of all stormwater discharges s at a <br />facility changes, the operator of the construction site shall submit <br />to the TCEO a Notice of Termination (NOT) and a copy of the <br />NOT to the City of San Marcos MS4 operator in accordance with <br />the Construction General Permit. The completed and signed NOT <br />shall be submitted to the City via is MyPermitNow.org. <br />Sec. 86.530. Permit Procedure Requirements. <br />The City of San Marcos can enforce compliance with the Cites <br />ordinances, permits, contracts, or orders in accordance with TPDES Phase II MS4 <br />Permit TXR040000. Permitting_ procedure requirements shall be in accordance <br />with the City's LDC, Chapter 2. <br />
