Sec. 86.531. Maintenance and Repair of Permanent Stormwater Facilities. <br />(a) Control Measures. The City of San Marcos has the authority to <br />require installation, implementation, and maintenance of temporary and <br />permanent control measures in accordance with TPDES Phase II MS4 Permit <br />TXR040000. <br />(b) Drainage Easements. Drainage easements shall be required for <br />permanent stormwater management facilities and recorded in accordance with the <br />City's LDC, Chapter 1, Article 7. <br />(c) Maintenance Covenants. Owner(s) of permanent stormwater <br />management facility(ies) shall be required to enter into a maintenance covenant <br />with the City of San Marcos including a schedule of maintenance activities and <br />plans for annual inspections to assess the functionality of the <br />facility(ies). Maintenance covenants shall be recorded in accordance with the <br />City's LDC, Chapter 1, Articles 6 and 8. <br />(d) Requirements for Annual Inspections and Reports. Owner(s) of <br />permanent stormwater management facility(ies) must conduct at a minimum an <br />annual inspection of each facility. The inspection report must be prepared by <br />Texas - licensed engineer and must describe all of the following_ <br />(1) An assessment of the condition of the stormwater management <br />facility, current as of the date of the report. <br />(2) A history of maintenance activities performed on the facility <br />during the past year. <br />(3 ) The professional opinion of the engineer regarding the current <br />functionality of the facility and its ability to provide total <br />suspended solids removal in accordance with the original design <br />specifications for the facility. <br />(4) Recommendations of the engineer regarding the need for <br />maintenance or modification of the facility to meet original design <br />specifications. <br />Any identified maintenance and repair needs must be adequately addressed to <br />ensure compliance with the requirements of this Division. The inspection report <br />must be maintained on site and available for inspection by the City of San <br />Marcos. <br />
