(e) Failure to Maintain Facilities or Practices. <br />(1) If the owner(s) responsible for maintaining_ the permanent <br />stormwater management facility fails to properly maintain the <br />facility, the City Stormwater Systems Manager will send a written <br />notice to the owner(s) to correct the problem within a reasonable <br />time, not less than five days nor more than thirty days from the <br />owners receipt of the notice. If the owner(s) fails to comply with <br />the notice, the Stormwater Systems Manager may initiate one of <br />the actions specified in Section 86.535. <br />2) If the permanent stormwater manacement facilitv becomes a <br />nuisance or danger to public safety public health, the City of <br />San Marcos shall notify the owner(s) responsible for maintenance <br />of the facility in writing. Upon receipt of that notice, the owner(s) <br />shall have 30 days to complete maintenance and repair <br />requirements. If the owner(s) of the facility fails to comply with <br />the requirements of the maintenance and/or repair notice, the City <br />of San Marcos, after reasonable notice, may take one or more of <br />the following actions: <br />a. Initiate enforcement action(s) as specified in Section <br />86.535 requiring the owner(s) to comply with City <br />ordinances. <br />b. Perform the required maintenance and /or repair, bill the <br />owner(s) for the cost of the maintenance /repair, and record <br />a lien against the property served by the stormwater <br />management facility(ies). <br />Sec. 86.532. Requirements for Stormwater Management Plan Compliance. <br />The Citv of San Marcos has the authoritv to receive and collect <br />information (e.g., stormwater pollution prevention plans, inspection reports, etc.) <br />from any person or entity (e.g., owner(s) or operator(s) of construction sites, <br />newly developed or redeveloped land, and industrial and commercial facilities in <br />accordance with TPDES Phase II MS4 Permit TXR040000 to assess compliance <br />with this permit. <br />Sec. 86.533. Authority to Enter and Inspect. <br />(a) The City of San Marcos has the authority to enter and inspect <br />private property related to stormwater discharges to the small MS4 in accordance <br />with TPDES Phase II MS4 Permit TXR040000. <br />
