Sec. 86.524. Applicability. <br />This Division applies to discharges entering the drainage system within <br />the jurisdictional limits of the City of San Marcos, unless exempted. <br />Sec. 86.525. Responsibility for Administration. <br />(a) The City of San Marcos shall administer, implement and enforce <br />the provisions of this Division. Any powers granted or duties imposed upon the <br />City Manager of the Citv of San Marcos may be delegated by the City Manager of <br />the City of San Marcos to persons or entities acting in the beneficial interest of the <br />City of San Marcos. <br />(b) Authorized individual(s) under this section shall have the authority <br />to enforce this Division in its entirety. Any person subject to an industrial or <br />construction TPDES stormwater discharge permit or authorization shall comply <br />with all provisions of the permit and be required by the City of San Marcos to <br />have authorization to discharge stormwater into the MS4 <br />Sec. 86.526. Prohibition of Illicit Connections and Discharges. <br />(a) The City of San Marcos has the authority to prohibit illicit <br />discharges and illicit connections in accordance with TPDES Phase II MS4 <br />Permit TXR040000. Illicit discharges are prohibited into the MS4 and/or Surface <br />Water in the State. No person shall release discharges into the MS4 containing <br />any pollutants that cause or contribute to a violation of water quality standards. <br />(b) Discharges from illicit connections are prohibited even if the <br />connection was allowable under previous rules and regulations. Allowable non - <br />stormwater discharges are listed in the TPDES Phase II MS4 Permit TXR040000 <br />Part II Section C. <br />Sec. 86.527. Response to Illicit Discharges. <br />(a) The City of San Marcos has the authority to respond to and contain <br />Illicit Discharges. The City of San Marcos must control the discharge of a spill <br />and prohibit dumping or disposal of material other than stormwater and <br />authorized non - stormwater discharges into the MS4 in accordance with TPDES <br />Phase II MS4 Permit TXR040000. Any person in violation of this Division may <br />risk having their discharge authorization to the MS4 terminated. The authorized <br />enforcement agency will notify the violator of the proposed termination of its <br />authorization. The violator may petition the City of San Marcos to reconsider and <br />schedule a hearing. <br />
