Sec. 86.524. Applicability. This Division applies to discharges entering the drainage system within the jurisdictional limits of the City of San Marcos, unless exempted. Sec. 86.525. Responsibility for Administration. (a) The City of San Marcos shall administer, implement and enforce the provisions of this Division. Any powers granted or duties imposed upon the City Manager of the Citv of San Marcos may be delegated by the City Manager of the City of San Marcos to persons or entities acting in the beneficial interest of the City of San Marcos. (b) Authorized individual(s) under this section shall have the authority to enforce this Division in its entirety. Any person subject to an industrial or construction TPDES stormwater discharge permit or authorization shall comply with all provisions of the permit and be required by the City of San Marcos to have authorization to discharge stormwater into the MS4 Sec. 86.526. Prohibition of Illicit Connections and Discharges. (a) The City of San Marcos has the authority to prohibit illicit discharges and illicit connections in accordance with TPDES Phase II MS4 Permit TXR040000. Illicit discharges are prohibited into the MS4 and/or Surface Water in the State. No person shall release discharges into the MS4 containing any pollutants that cause or contribute to a violation of water quality standards. (b) Discharges from illicit connections are prohibited even if the connection was allowable under previous rules and regulations. Allowable non - stormwater discharges are listed in the TPDES Phase II MS4 Permit TXR040000 Part II Section C. Sec. 86.527. Response to Illicit Discharges. (a) The City of San Marcos has the authority to respond to and contain Illicit Discharges. The City of San Marcos must control the discharge of a spill and prohibit dumping or disposal of material other than stormwater and authorized non - stormwater discharges into the MS4 in accordance with TPDES Phase II MS4 Permit TXR040000. Any person in violation of this Division may risk having their discharge authorization to the MS4 terminated. The authorized enforcement agency will notify the violator of the proposed termination of its authorization. The violator may petition the City of San Marcos to reconsider and schedule a hearing.
