(b) When the person responsible has knowledge of any known or <br />suspected release of materials resulting in or potentially resulting in unauthorized <br />discharges into a storm sewer system or surface water in the state, the person must <br />contain and clean U the release. If hazardous materials are released, the person <br />must immediately notify emergency response agencies. If non - hazardous <br />materials are released, the person must notify the authorized enforcement a ency <br />no later than the next business day. Notifications in person or by telephone must <br />be confirmed by written notice addressed and mailed to the City of San Marcos. <br />(c) Responsibilities. <br />(1) The person responsible for any facility, vehicle, or other source of <br />any spilling, leaking, pumping, pouring, emitting, emptying, <br />discharging, escaping, leaching dumping, disposing, or any other <br />release of any of the following substances into the MS4 or Surface <br />Water in the State, shall immediately notify the City of San Marcos <br />concerning the incident: <br />a. An amount equal to or in excess of a reportable quantity of <br />any hazardous substance, as established under 40 CFR Part <br />302, as amended; <br />b. An amount equal to or in excess of a reportable quantity of <br />any extremely hazardous substance, as established under 40 <br />CFR Part 355, as amended; <br />C. An amount of oil that either (i) violates annlicable water <br />quality standards, or (ii) causes a film or sheen upon or <br />discoloration of the surface of the water or an adjoining <br />shoreline or causes a sludge or emulsion to be deposited <br />beneath the surface of the water or upon an adjoining <br />shoreline; or <br />d. Any harmful quantity of any pollutant. <br />(2) The immediate notification required by subsection (c)(1) shall <br />include the following information: <br />a. The identity or chemical name of the substance released, <br />and whether the substance is a hazardous substance• <br />b. The exact location of the release, including any known <br />name of the waters involved or threatened and any other <br />environmental media affected• <br />C. The time and duration (thus far) of the release; <br />
