III Regular Meeting January 9, 1995 Page 4 Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, UPDATING ARTICLE III OF CHAPTER 10, FIRE PREVENTION AND PROTECTION, OF THE SAN MARCOS CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. Mr. Guerra moved for approval of the Ordinance on first reading and Mr. Hernandez seconded the motion. On roll call the following vote was recorded: AYE: Morris, Guerra, Cox, Hernandez. NAY: None. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, UPDATING CHAPTER 16, MISCELLANEOUS OFFENSES, OF THE SAN MARCOS CODE OF ORDINANCES; TRANSFERRING SECTIONS ON FENCE PERMITS AND ALCOHOLIC BEVERAGE LICENSES AND PERMITS TO CHAPTERS 5 AND 26, RESPECTIVELY, SETTING FEES FOR VARIOUS SERVICES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES, PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. Mr. Cox moved for approval of the Ordinance on first reading and Mr. Hart seconded the motion, which passed unanimously. Mayor Morris introduced for consideration approval of minutes of the Regular Meeting held December 12, 1994 and Special Meeting held December 19, 1994, approval of two Ordinances on second reading, and adoption of nine Resolutions on consensus. The Council removed Item 6.C.(9), adoption of a Resolution, to be considered separately. Mr. Guerra moved for approval of the minutes of the Regular Meeting held December 12, 1994 (Mayor Morris abstaining) and Special Meeting held December 19, 1994 (Messrs. Hart, Guerra and Hernandez voting Aye, Mayor Morris and Mr. Cox abstaining. The December 19, 1994 minutes therefore did not receive a majority vote of approval of the city Council and will be reconsidered at the next Regular Meeting), approval of the two Ordinances on second reading and adoption of the remaining eight Resolutions on consensus and Mr. Hart seconded the motion, which passed unanimously (Mr. Hart voting Nay to Item 6.B.[2], approval of Ordinance on second reading). The captions of the Ordinances and Resolutions read as follows: Approval of Ordinances on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 25, STREETS, SIDEWALKS, RIGHT-OF-WAY CONSTRUCTION AND OFF-STREET PARKING, OF THE SAN MARCOS CODE OF ORDINANCES TO ADD AN ARTICLE VII, ABANDONMENT OF CITY STREETS AND ALLEYS; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND DECLARING AN EFFECTIVE DATE. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE II, DEFINITIONS AND ARTICLE VI, SUBDIVISION DESIGN REQUIREMENTS OF APPENDIX C, SUBDIVISIONS OF THE SAN MARCOS CODE OF ORDINANCES, TO DEFINE "FLAG SHAPED LOTS" AND TO PROHIBIT SUCH LOTS WITHIN SUBDIVISIONS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING PENALTIES FOR VIOLATIONS.
