In the event that there are 15 active permits, any further <br />applications for locations in the district shall be placed <br />on a waiting list and individually referred to the <br />Commission for consideration within 45 days, in the same <br />order as submitted, when the number of active permits is <br />less than 15. <br /> <br />"3. In the event the commission authorizes ~ new TABC specific I <br />~ permit to be issued in the district, and a waiting ¡ <br />list exists for further applications, the applicant whose <br />permit was authorized must obtain the permit within 60 <br />days of the Commission decision to authorize the permit, <br />or the authorization is void and the next application on <br />the waiting list will be referred to the commission for <br />consideration within 45 days. <br /> <br />"4. The following revisions to active permits in the district <br />may be considered and made without regard for any waiting <br />list that may exist for new permits in the district: <br /> <br />"a. Administratively approved permits. <br /> <br />"b. Applications for revision of a curréntly valid permit <br />due solely to changes in the same business in the <br />same location," (as provided in memorandum from Mr. <br />Taylor to the council dated January 5, 1994). <br /> <br />Mr. Moore seconded Mayor Morris' amendment, which passed <br />unanimously. The Council then voted unanimously for approval of the <br />Ordinance on second reading. <br /> <br />Mayor Morris introduced for consideration reconsideration of a <br />Zoning Ordinance. The Council did not wish to reconsider the <br />Ordinance. The caption of the Ordinànce reads as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />26.00 ACRES OF LAND OUT OF THE EDWARD BURLESON SURVEY NO. 18, <br />A-63, HAYS COUNTY, TEXAS, LOCATED AT THE WEST CORNER OF THE <br />INTERSECTION OF IH-35 SOUTH AND CENTERPOINT ROAD, FROM UNZONED, <br />"PD" (PRE-DEVELOPMENT DISTRICT) AND "AR" (AGRICULTURAL-RANCH <br />DISTRICT) TO "C" (COMMERCIAL DISTRICT) AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration approval of minutes of the <br />Regular Meeting held December 13, 1993, approval of an Ordinance on <br />second reading, adoption of ten Resolutions, approval to permit <br />First Southwest Company to bid on the certificates of Obligation to <br />be considered by the city Council on February 14, 1994, and approval <br />to extend the deadline to February 15, 1994 for closing on the sale <br />of city property located at Hopkins and Cheatham to Red Line <br />Burgers, Inc. on consensus. The Council removed Item 9.C.(2), <br />adoption of a Resolution, to be considered separately. Mr. Guerra <br />moved for approval of the minutes of the Regular Meeting held <br />December 13, 1993, for approval of the Ordinance on second reading <br />(Mr. Hart abstaining on this item), for adoption of the remaining <br />nine Resolutions, for approval to permit First Southwest Company to Ì <br />bid on the certificates of Obligation to be considered by the City <br />council on February 14, 1994, and for approval to extend the <br />deadline to February 15, 1994 for the closing on City property to <br />Red Line Burgers, Inc. and Mr. Moore seconded the motion, which <br />passed unanimously.
