<br />8 <br /> <br /> <br />Regular Meeting January 10, 1994 Page 8 <br /> <br /> <br />Mr. Taylor advised ownership of the land and building together is <br />the best way or the details nailed down. Mr. Guerra stated he was <br />comfortable in the $42,000 funding request being requested of the <br />CDBG funding and would consider the city funding if other grants do <br />not work out. Mr. Tatum stated they want to work in partnership <br />with the city and want a faster pace. Mayor Morris requested Mr. <br />Tatum talk with NAACP and see what they can financially come up <br />with. I <br /> <br />Mayor Morris introduced a discussion regarding a request for <br />disannexation of 3.93 acres of land out of the Thomas W. Forsyth <br />Survey located at 2004 Ranch Road 12 (DeLong) and 2.15 acres of <br />land out of the Thomas W. Forsyth Survey, located at 1980 Ranch Road <br />12 (House) and direction to staff. Mr. Guerra stated he has <br />reservations ~bout the City agreeing to disannex this property. Mr. <br />Hart thinks rather than disannex this property, the Crestwood strip <br />center should be brought into the City limits. Mr. Moore stated <br />strip annexation on Ranch Road 12 was to control the strip centers <br />and aquifer. He agrees he does not think this request is justified. <br />Mr. Cox stated he voted against the last disannexation. He stated <br />the City's Master Plan will be updated within the year and this area <br />would probably be annexed back into the city. He is opposed.to this <br />disannexation. Mrs. DeLong stated the cost to conn~ct to the city's <br />water and wastewater is prohibitive. They want to have fire and <br />police protection and not need to argue whether or not they are in <br />the City limits every time they need assistance. Dr. House stated <br />he would be more comfortable if Crestwood Center was annexed into <br />the city. He stated there is a topless bar in the Crestwood Center <br />that causes problems for the area. He also stated a dog was shot on <br />the property next to the DeLongs, and would hope for better control <br />if the area was annexed. The Council stated this property will <br />remain a part of the City limits (Mr. Cox left the meeting after <br />this discussion). ¡ <br />I <br />Mayor Morris introduced Item 10.A., receiving a report and <br />presentation by Tucker Gibson of Gibson Research Group regarding an <br />analysis of city census and election data under the Federal Voting <br />Rights Act. Dr. Gibson provided the Council with a written report <br />and briefly reviewed his conclusions. A copy of his report is <br />attached to these minutes. <br /> <br />Mayor Morris stated due to the late hour, Item 10.B. would be <br />postponed to another meeting, a discussion with Lewis McClain <br />regarding water conservation rates and direction to staff. <br /> <br />Mayor Morris introduced the City Manager's Report. (1) Mr. Gilley <br />advised the Council the Helping Hands Program continues to exist but <br />is not an active program and has no current activities. Mr. Gilley <br />stated we now have the Project Safe Place, a crime prevention <br />program, which will use some of the same aspects as the Helping <br />Hands Prågram. (2) Mr. Gilley stated the TNRCC program is asking <br />San Marcos' to participate. He stated this is an environmental <br />program. Once the city makes application, we will be a partner in <br />the program. . <br /> <br />Mayor Morris introduced the city Attorney's Report. Mr. Taylor had <br />no report. I <br />I <br />Mayor Morris introduced,the City council's Report. (1) ;Mr. Cox, ! <br />Mrs. Millecam and Mr. Jenkins are working on a format and basic <br />criteria for the Drainage'Master Plan. The Councìl needs to IDake a <br />decision on what level to define for the plan. A public hearing <br />will be held on Monday, January 17. (2) The City may be able to <br />move forward with a Curfew Ordinance. (3),' Mayor Morr'is has been <br />appointed Chair of the NLC FAIR Comm~ttee. (4) Mr. Guerra wrote a <br />letter in the Town and city publication regarding San Marcos' city <br />Manager for a Day. ' <br /> <br />Mayor Morris introduced an Executive Session pursuant to Chapter 551 <br />of the Government Code, Section 551.071, to discuss pending <br />litigation (sierra Club vs. Babbitt; McDonald vs. city of San <br />Marcos), and contemplated litigation; and sections 551.072 and <br />
