<br /> 8 <br /> ;î <br /> \ \IJ <br /> RESOLUTION 1994- 110 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS 1 TEXAS 1 TERMINATING A COMPUTER SOFTWARE <br /> LICENSE AND MAINTENANCE AGREEMENT WITH DB ' <br /> INFORMATION SYSTEMS 1 INC.; AUTHORIZING THE CITY <br /> MANAGER TO EXECUTE A LETTER OF TERMINATION ON <br /> BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br />I RECITALS: <br /> 1. In July 19931 the City of San Marcos (the <br /> "City") issued a Request for Proposals for an interactive <br /> computer system for the automation of the Municipal Court. <br /> 2. On July 131 1993, the City entered into a <br /> Computer Software License and Maintenance Agreement with DB <br /> Information"" Systems 1 Inc. (DBI) for the provision of <br /> municipal court software. <br /> 3. On March 28, 1994, the City approved Amendment <br /> No. 1 to its agreement with DBI to give DBI until June 301 <br /> 1994 to successfully complete the installation of municipal <br /> court software which meets the functional requirements of the <br /> original agreement or to allow for the termina-tion of the <br /> contract by the City. <br /> 4. DBI failed to meet the deadline for successful <br /> installation of the software by June 30, 1994. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS 1 TEXAS: <br /> PART 1. That the Computer Software License and <br /> Maintenance Agreement between the City and DBI is terminated. <br /> PART 2. That the City Manager, Larry D. GilleYI <br /> is authorized to notify DBI of this termination on behalf of <br /> the City. <br /> PART 3.
