<br />3 <br /> <br /> <br /> <br />- Regular Meeting October 10, 1994 Page 3 <br /> <br /> <br />Mayor Morris introduced the city Manager's Report. (1) Mr. Gilley <br />provided the Council with an update on fraternity/sorority specific <br />use permits (SUPs). He stated there are seven permitted sororities <br />with no penalty points. Three of the fraternities permitted last <br />year are no longer at SWT. Mr. Guerra stated Alpha Tau Omega has <br />relocated. Mr. Gilley stated nine other fraternities nave SUPs, <br />~~ with four receiving extensions regarding parking issues. He stated <br />¡ one fraternity is not validated (Kappa Alpha) currently. He will <br />forward an update to the Council on these SUPs. In the process <br />police officers are to forward reports to the Planning Department to <br />assess points, but if no citation is issued, no points are deducted <br />from the fraternity/sorority SUP. (2) Mr. Gilley stated in regard <br />to the State's restriping of Ranch Road 12 at Hutchison, he has been <br />in contact with the Highway Department and they are going to redo <br />the striping. (3) Mr. Gilley advised the Council on October 7 the <br />City was contacted by the Justice Department that a grant we applied <br />for a year ago has been approved with the passage of the new crime <br />bill. It is a three-year matching grant in the total amount of <br />$69,838.00 for a resource officer in the school system. <br /> <br />Mayor Morris introduced the city Attorney's Report. Mr. Taylor has <br />done a survey of other Texas cities regarding regulation of tows on <br />private parking lots and stated San Antonio, Austin, College Station <br />and Lubbock do regulate. San Antonio regulates rates with a cap at <br />$45.00 per tow. Signs are required to be posted in private parking <br />lots, and cities can be more stringent, as San Antonio requires the <br />tow fee to be on their signs. Mayor Morris added with the passage <br />of the Airport Improvements Act, the Federal Government had a tag <br />which allows cities to regulate garbage and tow trucks, and she has <br />requested a copy for the City's review. <br /> <br />Mayor Morris introduced a discussion regarding Council Member Robert <br />Mooney's evaluation format for the appointees. Mr. Mooney has <br />prepared criteria referenced evaluation forms, which set standards <br />how the appointees will be measured and provision what goals the <br />Council want achieved in the coming year. The Council will evaluate <br />the City Manager and City Attorney on October 24 and City Secretary <br />and Municipal Court Judge on November 14, if possible. <br /> <br />Mayor Morris introduced the city Council's Report. (1) Mr. Guerra <br />questioned why two hemp stores are allowed to operate in. our City, <br />and Chief Kendrick advised him they are operating legally at this <br />time. Mr. Taylor advised the locations could be controlled through <br />zoning and could require them to be located certain distances from <br />particular types of businesses. (2) Mayor Morris asked if the <br />Police Department would be interested in having their patches be <br />consistent with the City seal, and Chief Kendrick advised they <br />prefer to have their own patch. (3) Mr. Mooney reported the EMS <br />Board is now complete, and Dr. Ken Long will serve as the physician <br />appointed by the Board. They plan to meet the third Tuesday of this <br />month, October 18 at 5:00 p.m. Mr. Mooney is Chair of the Board, <br />and they plan to work on the bylaws of the Board to conform with the <br />contract. <br /> <br />Mayor Morris introduced an Executive Session pursuant to the <br />. Government Code, Section 551.071, to discuss pending litigation <br />¡ (Sierra Club vs. Babbitt¡ MacKenzie vs. City of San Marcos¡ Tamez <br />vs. City of Marcos); and matters where the City Attorney's ethical <br />- duty to the city clearly conflicts with Government Code, Chapter <br />551; Sections 551.072 and 551.073, to discuss purchase of real <br />property and value of real property¡ and Section 551.074, to <br />discuss evaluation of public officers (City Manager, City Secretary, <br />city Attorney, Municipal Court Judge). Mr. Guerra moved to adjourn <br />at 9:53 p.m. and Mr. Hernandez seconded the motion, which passed <br />unanimously. <br /> <br />Mr. Mooney moved to reconvene at 10:37 p.m. and Mr. Moore seconded <br />the motion, which passed unanimously. <br />
