25 Regular Meeting November 14, 1994 Page 3 Mr. Cox moved for approval of the Ordinance on second reading and Mr. Moore seconded the motion. Mayor Morris moved to amend the Ordinance in SECTION 2 to add, "In order to allow users the opportunity to make changes in operations and install pretreatment facilities, the charging of surcharges will not begin until six months after the effective date of this ordinance," and Mr. Moore seconded the motion, which passed unanimously. The Council directed the City Attorney provide wording for Council consideration at third reading that at the end of the six-month moratorium period surcharge caps be put in place. The Council voted unanimously for approval of the Ordinance on second reading. Mayor Morris introduced for consideration approval of minutes of the Regular Meeting held October 24, 1994 and adoption of six Resolutions ,on consensus. The Council removed Items 8.B. (1) and 8.B. (3), adoption of Resolutions, to be considered separately. Mr. Moore moved for approval of the minutes of the Regular Meeting held October 24, 1994 (Mr. Cox abstaining) and for adoption of the remaining four Resolutions on consensus and Mr. Hart seconded the motion, which passed unanimously. The captions of the Resolutions read as follows: Adoption of Resolutions: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING REVISED SALARY SCHEDULES FOR CITY EMPLOYEES WHO ARE NOT SUBJECT TO STATE CIVIL SERVICE STATUTES; AND DECLARING AN EFFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AGREEMENTS BETWEEN THE CITY AND THE TEXAS DEPARTMENT OF LICENSING AND REGULATION TO ALLOW CITY INSPECTORS TO PERFORM PLAN REVIEW AND INSPECTION SERVICES; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS CONTRACT ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO. 1 TO THE COMPUTER SERVICES AGREEMENT BETWEEN THE CITY AND Q.I.V. SYSTEMS, INC. AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN E~FECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE RENEWAL OF HARDWARE MAINTENANCE CONTRACTS WITH DATA GENERAL CORPORATION AS A SOLE SOURCE PROCUREMENT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT RENEWALS ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. Mayor Morris introduced for consideration Item 8.B.(1) removed from the consensus agenda, adoption of' a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, EXPRESSING THE CITY'S POSITION ON THE EDWARDS AQUIFER INTERLOCAL CONTRACT BETWEEN THE EDWARDS UNDERGROUND WATER DISTRICT, THE MEDINA COUNTY UNDERGROUND WATER CONSERVATION DISTRICT AND THE UVALDE COUNTY UNDERGROUND WATER CONSERVATION DISTRICT; AND DECLARING AN EFFECTIVE DATE. Mr. Moore moved for adoption of the Resolution and Mr. Hart seconded the motion (Mr. Guerra present at this time - 8:18 p.m.). Edwards' thoughts are this will be the last solution to the problems. Other governmental entities are being asked to join us in killing legislation as the final solution. Mr. Moore expressed his concerns are permits and pumpage limits. Mr. Moore thought New Braunfels and Comal County will be adopting Resolutions as well. Mr. Armbrister has stated he is committed to fixing 1477 in the eyes of the Justice Department, and is of the opinion new changes will not get a hearing. The Council voted unanimously for adoption of the Resolution.
