27 Regular Meeting November 14, 1994 Page 5 Mayor Morris introduced an Executive Session pursuant to the Government Code, section 551.071, to discuss pending litigation (Sierra Club vs. Babbitt; MacKenzie vs. City of San Marcos; ortiz vs. City of San Marcos; Sharp vs. civil Service Commission) and matters where the city Attorney's ethical duty to the city clearly conflicts with Government Code Chapter 551; sections 551'.072 and 551.073 to discuss purchase of real property; and section 551.074 to discuss evaluations of public employees (city Attorney, city Secretary). Mr. Guerra moved to adjourn into Executive Session at 9:42 p.m. and Mayor Morris seconded the motion, which passed unanimously. Mr. Hernandez moved to reconvene at 12:14 a.m. and Mr. Hart seconded the motion, which passed unanimously. Mayor Morris'introduced for consideration approval to set salaries for the City Manager, Municipal Court Judge, city Attorney and city Secretary.
