<br />12 <br /> <br /> <br /> <br />Regular Meeting October 24, 1994 Page 4 <br /> <br /> <br />Mayor Morris introduced for consideration Item 6.C.(4) removed from <br />the consensus agenda, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AN AGREEMENT BETWEEN THE CITY AND BEATY <br />SAUNDERS ARCHITECTS FOR PROFESSIONAL SERVICES IN CONNECTION <br />WITH THE CONSTRUCTION OF AN ACTIVITY CENTER; AUTHORIZING THE-- <br />CITY MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Resolution and Mr. Hernandez <br />seconded the motion. Mr. Mooney stated he had a question on Page 14 <br />in section 13.2.1 regarding the dollar figure following Principal. <br />Mr. Saunders clarified the amount is $95 and the hyphen that <br />appeared wasèa typographical error that will be corrected. The <br />Council voted unanimously for adoption of the Resolution. <br /> <br />Mayor Morris introduced for consideration Item 6.C.(5) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT <br />BETWEEN THE CITY AND THE CENTRAL TEXAS WING OF THE CONFEDERATE <br />AIR FORCE AMENDING THE LEASE OF AIRPORT PROPERTY, AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE <br />CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Resolution and Mr. Mooney <br />seconded the motion. Mr. Mooney questioned if Staff really felt <br />losing 35% was going to be a good deal for the City. Mr. Gilley <br />stated based on the information we have reviewed, Staff thinks it <br />will be about equal to the same amount we are receiving now. <br />Primarily the reason for the change is for clarification. Under the <br />old agreement the payment called for one-half of the gross margin <br />proceeds, and that was the confusing language. That margin deducted <br />the CAF purchases by members and a variety of other things. By <br />going to the 15% gross proceeds amount, it is much clearer for <br />everyone to evaluate the accuracy of numbers, and we are also moving <br />to a quarterly payment. The Council voted unanimously for adoption <br />of the Resolution. <br /> <br />Mayor Morris introduced the city Manager's Report. Mr. Gilley <br />reported he has been involved in a discussion regarding the Sierra <br />Club vs. Babbitt lawsuit regarding the Endangered Species Act. The <br />panel is still pretty much in the information gathering stage, and <br />it is his hope as we get nearer the conclusion of the 60-day time <br />limit that Judge Bunton has allowed this process to occur that we <br />will have been able to actively participate and encourage all the <br />folks on the Edwards Aquifer to reduce their pumping. That still <br />remains our fundamental goal. The Council is invited to attend the <br />meetings and participate in that discussion. <br /> <br />Mayor Morris introduced the city Attorney's Report. Assistant city <br />Attorney Collete Davis had no report at this meeting. <br /> <br />Mayor Morris introduced the City Council's Report. (1) Mayor <br />Morris stated in the last SMEU meeting Betty Kissler was elected <br />SMEU Chair and Russell Thornton Vice Chair. There was also a ¡ <br />discussion about the need to continue the SMEU Board. The SMEU <br />Board has recommended the city Council agree to continue it, not <br />dissolve it, based on the memo from Mark Taylor regarding the makeup <br />of the Board that was sent out a couple weeks ago. Additionally, <br />Mayor Morris assured them she thought the Council would want the <br />SMEU Board to continue, but would bring it to the attention of the <br />Council. It was also brought up the Council might want to consider <br />a utilities Board to look over water, wastewater and electric <br />utilities, and she told them she would pass that information to the <br />Council. If at any point the Council wants to agendize that or get <br />more information from Mr. Gilley, the Council can do that. (2) <br />Mayor Morris spoke with Jeff Barton over the weekend. The County is <br />entering into an interlocal agreement with the City of Buda. They <br />
