.

13

Regular Meeting October 24, 1994 Page 5

do not have a police department but have a park and need assistance
from the Sheriff's Office to enforce the curfew. This interlocal
agreement calls for the Sheriff's Office to make a sweep through the
park when making regular rounds in Buda. The park is in the Buda
city limits. Mr. Barton was concerned the other cities in the
County be made aware of this agreement. It calls for a sharing of
fees associated with any fines from enforcement. Mayor Morris
expressed the agreement was fine, and if the city of San Marcos
needed an agreement of that nature, we would feel comfortable with
going to the County for that. They also talked about the numerous
interlocal agreements of the city and County. One is the jailing of
city prisoners. He stated there is an $800,000.00 expenditure he is
going to look into. Mayor Morris asked for more information on
that. Mayor Morris asked the Council to think about what the value
of this would be if the city housed these prisoners. Mr. Barton
stated that figure might include prisoners from other cities; he was
not sure and would get more information. (3) Mayor Morris stated
for the Council to give special attention next week at TML to
unfunded mandates. (4) Mayor Morris stated Mr. Guerra is getting
ready to conclude his year as TML President. He has been a source
of pride for all the city, and told Mr. Guerra he has done a good
job.
.
Mayor Morris introduced an Executive Session pursuant to the
Government Code, Section 551.071, to discuss pending litigation
(Sierra Club vs. Babbitt; Roberts vs. City of San Marcos; Southern
Climate Co. vs. J. K. Richardson Co.); sections 551.072 and 551.073,
to discuss value of real property; and Section 551.074, to discuss
evaluation of public employees (Municipal Court Judge, city Manager)
and duties of a public employee (City Manager). Mr. Mooney moved
the Council adjourn at 9:54 p.m. and Mr. Moore seconded the motion,
which passed unanimously (Mr. Hernandez left the meeting at 10:00
p.m.).

Mr. Guerra moved the Council reconvene at 1:48 a.m. and Mr. Moore
seconded the motion, which passed unanimously.

The meeting adjourned at 1:49 a.m. on motion made by Mr. Moore and
seconded by~. ~erra. \ ~. ~

~orriS
JS~ ,~ ~?õ'/

Robert Mooney

COli ' ember :..i~i~mber t...

. art Fred ~
Council Member Mayor Pro-Tem

Rick Hernandez
Council Member

AT'DEST : ~ (\, I

- c/tY ¡b/1¡'¿ LJ. f!¡fYl/6 rJ/)
Jþ:Íns K.
