City Council Meeting Minutes June 7, 2016 <br />"UBLIC HEARINGS - 7:00 PM <br />10. TOOPM Receive a Staff presentation and hold a Public Hearing to receive comments <br />for or against Ordinance 2016 -20, amending the Land Use Matrix and Dimensional <br />Standards in Chapter 4 of the City's Land Development Code to modify the permitted <br />conditional and prohibited uses and establish a four story building height restriction <br />within "P" Public and Institutional Zoning Districts; providing a savings clause; <br />providing for the repeal of any conflicting provisions; and providing an effective date; <br />and consider approval of Ordinance 2016 -20, on the first of two readings. <br />Shannon Mattingly, Director of Development Services, provided the Council <br />with an overview of the item. <br />Mayor Guerrero opened the Public Nearing at 7:45 p.m. <br />There being no comments, Mayor Guerrero closed the Public Bearing at 7:45 <br />p.m. <br />Main Motion: A motion was made by Deputy Mayor Pro Tem Prewitt, <br />seconded by Mayor Pro -Tem Thomaides, that Ordinance 2016 -20 be approved, <br />on the first of two readings. <br />Motion to Amend: A motion was made by Deputy Mayor Pro Tern Prewitt, <br />seconded by Council Member Derrick, that Ordinance 2016 -20 be amended by <br />adding the following at the bottom of Table 4.1.6.1 <br />Dimensional and Development Standards, " * ** All government uses shall be <br />exempt from the building height restrictions. Taller structures may be <br />approved by Conditional Use Permit upon recommendation by the Planning & <br />Zoning Commission and approval by City Council." The motion carried by the <br />following vote: <br />A motion was made by Deputy Mayor Pro Tern Prewitt, seconded by Mayor <br />Pro -Tem Thomaides, that Ordinance 2016 -20 be approved as amended, on the <br />first of two readings. TOOPM Receive a Staff presentation and hold a Public Hearing to receive comments <br />for or against Resolution No. 2016 -74R approving a partial assignment of a <br />Development Agreement for the Buie Tract from Craddock Avenue Partners L.L.C. to <br />KDG Craddock Partners to KDG Craddock Partners I, L.L.0 as to 10.02 acres of land <br />located along Craddock Avenue at Bishop Street; Authorizing the City Manager to <br />execute a consent to the partial assignment on behalf of the City; and declaring an <br />effective date; and consider approval of Resolution 2016 -74R. <br />City of San Marcos Page 5 <br />
