Ms. Huffman stated it was being pursued. <br /> Mayor Morris introduced an Executive Session pursuant to the Government Code, <br /> Section 551.071, to discuss pending litigation (Sierra Club vs. Babbitt) and matters <br />.- where the City Attorne's ethical duty to the City clearly conflicts with Government Code <br /> Chapter 551; and Sections 551.072 and 551.073, to discuss the value of real property. <br /> Mr. Hart moved to adjourn into Executive Session at 11 :25 p.m. and Mr. Moore <br /> seconded the motion, which passed unanimously. <br /> Mr. Moore moved the Council reconvene at 12:58 p.m. and Mr. Guerra seconded the <br /> motion, which passed unanimously. <br /> Mayor Morris stated for the record, in Executive Session the Council directed the staff <br /> to finalize the application for a 9 million gallon a day plant upgrade based on <br /> information by Black & Veatch and authorized field work and study work for additional <br /> modeling.
