<br />144 <br /> <br /> <br /> <br />Regular Meeting June 27, 1994 Page 3 <br /> <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Morris closed the public hearing. Mr. <br />Cox moved for approval of the Ordinance on first reading and Mr. <br />Hart seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />approval of an Ordinance on first reading, the caption which was <br />read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, CHANGING THE NAME OF LIVE OAK STREET TO ACORN STREET <br />BETWEEN NORTH L.B.J. DRIVE AND CHESTNUT STREET; PROVIDING FOR <br />PUBLICATION AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. No òne did, so Mayor Morris closed the public hearing. Mr. <br />Mooney moved for approval of the Ordinance on first reading and Mr. <br />Moore seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY~OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 2-73(c) OF THE CITY'S CODE OF ETHICS <br />REGARDING RESTRICTIONS ON CITY OFFICERS AND EMPLOYEES APPEARING <br />IN A PRIVATE CAPACITY BEFORE DEPARTMENTS, AGENCIES, BOARDS AND <br />COMMISSIONS OF WHICH THEY ARE NOT MEMBERS; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A <br />PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on second reading and <br />Mr. Mooney seconded the motion. Mr. Moore moved to amend the <br />Ordinance to add a section 2-73(e) as follows, l1(e) A member of the <br />planning and zoning commission shall not knowingly represent the <br />member or any other person, group or interest before the zoning <br />board of adjustments on any matter involving land use or <br />development, and a member of the zoning board of adjustments shall <br />not knowingly represent the member or any other person, group or <br />interest before the planning and zoning commission on any matter <br />involving land use or development. These restrictions do not apply <br />to members representing their interests in their owner-occupied <br />homesteads,11 and Mr. Mooney seconded the motion. On roll call of <br />the amendment, the following vote was recorded: <br /> <br />AYE: Moore, Mooney, Morris, Cox. <br /> <br />NAY: Hart. <br /> <br />ABSTAIN: None. <br /> <br />On roll call for approval of the Ordinance on second reading, the <br />following vote was recorded: <br /> <br />AYE: Moore, Mooney, Hart, Morris. <br /> <br />, <br />. NAY: Cox. <br /> <br />- ABSTAIN: None. <br /> <br />Mayor Morris introduced for consideration reconsideration of two <br />zoning Ordinances. The Council did not wish to reconsider either of <br />these Ordinances. The captions of these Ordinances read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />17.74 ACRES TRACT OF PROPERTY, LOCATED IN THE 1200 BLOCK OF <br />WONDER WORLD DRIVE, FROM "LB" (LIMITED BUSINESS DISTRICT) AND <br />"C" (COMMERCIAL DISTRICT) TO "MF-5" (MULTI-FAMILY DISTRICT <br />[HIGH DENSITY]) AND DECLARING AN EFFECTIVE DATE. <br />
