• ORDINANCE 2009 - 39 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 2, ADMINISTRATION, <br />DIVISION 17, YOUTH COMMISSION OF THE SAN MARCOS CITY <br />CODE TO ESTABLISH A YOUTH ACTIVITIES FUND; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE <br />DATE. <br />RECITALS: <br />1. The San Marcos Youth Commission has recommended that the City Council approve <br />changes to Chapter 2, Division, of the San Marcos City Code, including the following: <br />A. The addition of fund raising activities to the commission's powers and duties; <br />B. The addition of a requirement to create fund raising guidelines to the commission's <br />powers and duties; and <br />C. The establishment of a Youth Activities Fund. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 2, Division 15 of the San Marcos Land Development Code is <br />• amended as follows (underlining indicates added text, stfikethfoug indicates deleted text: <br />DIVISION 15. YOUTH COMMISSION <br />Sec. 2.362. Established; composition; terms. <br />(a) The San Marcos Youth Commission is established. The commission is composed of <br />seven members appointed by the city council, and shall consist of two persons representing <br />youth-serving agencies and five at-large positions. <br />(b) Members of the commission are appointed by the city council for terms of three <br />years. Members will serve until their successors are appointed and qualified. <br />Sec. 2.363. Powers and duties. <br />(a) The youth commission may adopt rules and regulations to govern its actions, subject <br />to the general laws of the state and of city ordinances and resolutions. The youth commission <br />shall adopt written rules and guidelines prior to engaging in any fund raising activities_ <br />(b) The commission acts in an advisory capacity to the city council, the parks and <br />recreation Board, other boards and commissions and the city manager on matters involving youth <br />in the San Marcos community. For purposes of this division, the term "youth" means a person <br />• 18 years or younger in age. The commission will endeavor to involve the entire community in
