<br />63 <br />Regular Meeting February 14, 1994 Page 2 <br />at the next meeting. <br />Mayor Morris stated the city council would return to the bids for <br />purchase of Combination Tax and Revenue certificates of obligation, <br />series 1994, in the amount of $1,500,000.00. Mr. Nitchalous advised <br />the Council the low bidder was The Principal/Eppler, Guerin & <br />Turner, Inc. with a gross interest cost of $315,344.01, less premium ~- <br />$31.20, for a net interest cost of $315,312.81 with an effective <br />interest rate of 4.216351%. To award bid the Council moved to Item <br />8.A., adoption of an Ordinance on emergency, the caption which was <br />read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, <br /> TEXAS COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION, <br /> SERIES 1994, IN THE AGGREGATE PRINCIPAL AMOUNT OF $1,500,000; <br /> PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID <br /> CERTIFICATES; PRESCRIBING THE FORM OF SAID CERTIFICATES; <br /> AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; <br /> ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT; AND <br /> DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Mooney seconded the motion. Mayor Morris moved to amend the <br />Ordinance on Page 5 in section 3.02(b) to provide the following <br />interest rates: "1995 - 3.90%, 1996 - 5.90%, 1997 - 4.05%, 1998 - <br />3.90%; 1999 - 4.00%; 2000 - 4.20% and 2001 - 4.25%" and on Page 19 <br />in section 7.01(a) to award bid to "The Principal/Eppler, Guerin & <br />Turner, Inc." and the premium in the amount of "$31.20", and Mr. <br />Moore seconded the motion, which passed unanimously. The Council <br />then voted unanimously for adoption of the Ordinance on emergency. <br />Mayor Morris introduced receiving the Report of the Charter Review <br />Commission and direction to Staff. æhe Council received the written <br />Report of the Charter Review Commission and Mrs. Ofelia <br />Vasquez-Philo, Chair, and several Commissioners were present to <br />answer questions of the Council. The recommendations included <br />combining the Planning and Zoning Commissions as one Commission with <br />eleven members. The Council discussed and reviewed many of the <br />recommendations. The Council discussed the recommendation on Page 7 <br />of the Report, section 4.01(c) (2) regarding the city Manager's <br />duties. It was consensus of Council for Council to no longer have <br />authority to remove Directors or confirm the appointments of the <br />Directors as made by the 'city Manager and that Council would have <br />authority to approve the four appointees (city Manager, city <br />Secretary, City Attorney and Municipal Court Judge) and their <br />assistants and would have authority to remove the appointees and <br />their assistants. The Council directed the recommendations of the <br />Charter Review Commission and the above exception to the Report be <br />included on the May 7, 1994 ballot. A Special Meeting will be held <br />at 12:00 Noon on Tuesday, February 22, 1994 to include the Charter <br />Amendments in the Election Ordinance that will be adopted at this <br />meeting. The Council thanked the Charter Review Commission for <br />their thorough review and recommendations. <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Resolution, the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE ISSUANCE OF A CERTIFICATE OF PUBLIC <br /> CONVENIENCE AND NECESSITY TO RAUL MENDEZ D/B/A PROGRESSIVE VAN <br /> LINES FOR THE PROVISION OF TAXICAB SERVICES IN SAN MARCOS; AND <br /> DECLARING AN EFFECTIVE DATE. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. Raul Mendez asked for the Council's approval and stated he <br />provides a service between Austin and San Marcos for approximately <br />fifty passengers per day as a commuter service. Louise Greene <br />stated another service will dilute the two existing businesses and <br />wants to know if the service will be limited service to Austin and <br />was advised there were no limitations to Mr. Mendez' service.
