8 <br />Regular Meeting February 10, 1997 Page 8 <br />Wueller stated he hoped the Council would give a fair consideration to locally owned and <br />operated businesses and would wait for an opportunity. Ms. Hughson asked how many <br />businesses would there be that would bid. Mr. Wueller stated there was a possibility of five <br />that could do it. Mr. Jack Clement with BFI stated a lot goes into maintaining a contract <br />properly and being a satisfactory vendor for the City, entailing many things on a day to day <br />basis. Mr. Clement stated it has been about 14 years and the City has never had to go out <br />on bids because it has been satisfied with the services and prices. Mr. Clement stated BFI <br />wanted to continue to keep the City's business and had demonstrated in providing a pilot f ' <br />program at BFI's cost to demonstrate to the City a change that might be a new and good <br />thing for the City. Mr. Clement stated they are welcome to consider negotiating with the <br />City and hope the Council will give consideration. Mr. Hernandez stated he appreciates <br />BFI's level of service and would like to direct staff to come up with different numbers and <br />give the Council an update to see whether the Council would like to go out for RFP's. Mr. <br />Gilley suggested, the Council attempt to do it at the next regular meeting because the <br />meetings on the 27th and 28th are workshops. Ms. Hughson stated that no matter what <br />number staff comes up with, she would not know if it was the best deal out there. Mr. <br />Mihalkanin agreed. Mr. Hart, Mr. Cox and Mr. Hernandez stated that the staff work out a <br />deal. The Mayor stated there were three council members that would like to give Mr. <br />Gilley time and if by that time Mr. Gilley did not come up with what he thought was a <br />satisfactory and convincing settlement, then the Council would agree to go out for the full <br />bid process. Mr. Cox stated that a citizen had suggested to him that it should be <br />mentioned in the contract negotiation or in the RFP that picking up the containers <br />downtown should be built into the contract. Mr. Cox stated the other suggestion was the <br />concern on hazardous waste. Mr. Cox stated that the citizen had asked whether SWT had <br />a hazardous waste contract and maybe it would be easier for the City to tie in with them. <br />Mayor Moore introduced the City Manager's Report. Mr. Gilley had no report at this <br />meeting. <br />Mayor Moore introduced the City Attorney's Report. Mr. Taylor had no report at this <br />meeting. <br />Mayor Moore introduced the City Council's Report. (1) Ms. Hughson wanted to <br />remind citizens that this Thursday, the Planning and Zoning Commission was going to <br />meet with the Neighborhood Council regarding issues on Capital Improvements plans. (2) <br />Ms. Hughson stated she wanted to know whether the Council had asked for attendance <br />records on folks who wanted to serve on commissions or did the Council just want to know <br />if their attendance records are bad. Ms. Hughson stated she is still interested in seeing the <br />attendance records. Mr. Hernandez stated the Council would get them if there was an <br />existing problem and that is probably why they have not received them. (3) Mayor Moore <br />stated that he wanted to announce the upcoming water seminar. (4) Mr. Cox stated he had <br />spoken to Dr. Supple regarding university and city issues. Mr. Cox stated one was the <br />downtown parking, bar extension issue, master plan, transportation, infrastructure issues <br />and traffic matters. Mr. Cox stated if the City has suggestions for improving, Dr. Supple <br />would like to know. Mayor Moore stated the City is presently looking for a date to have the <br />University to have a discussion, and that some of the Council is not really interested in a <br />presentation as an academic source but willing to get down to some of the issues Mr. Cox <br />stated. <br />Mayor Moore introduced an Executive Session pursuant to the Government Code, Section <br />551.071, to discuss contemplated litigation (Aquarena Springs property taxation) and <br />matters where the City Attorney's ethical duty to the City clearly conflicts with Government <br />Code, Chapter 551 (SWTSU Electric Supply Contract); and Section 551.074, duties of a <br />public officer (City Manager). Mr. Hernandez moved to adjourn in Executive Session at <br />11:49 p.m. and Mr. Mihalkanin seconded the motion, which passed unanimously. <br />Mr.Mihalkananin moved to reconvene at 12:23 p.m. and Mr. Hart seconded the motion <br />which passed unanimously.
