<br /> - 14l <br />Regular Meeting April 28, 1997' Page 13 <br />Reyna place everything in writing and give it to Mr. Robert Ronson. Mr. Reyna stated he <br />did and Mr. Ronson did everything for him. Mr. Reyna stated when he went back to buy <br />his permits he was told by Ms. Tommie Mayweld she could not sell him the permits <br />because she had a letter telling her not to sell him anything. Mr. Reyna stated he spoke <br />to Senator Barrientos and when he called they finally issued the permit but told him they <br />still could not sell him the permit for his plumbing or electric because their assumption was <br />he was not going to live in this home. Mr. Reyna stated he also spoke to the Fire Marshal <br />regarding the electrical wire which was not even hooked to his box and he had never <br />requested it. Mr. Reyna stated it has come to the point where they have been red tagging <br />him for everything he does. Mr. Reyna stated the Fire Marshal advised him to go in front <br />of the Appeals Board to file his complaint. Mr. Reyna stated he did and his permits for <br />plumbing and electric were denied. Mr. Reyna stated the Appeals Board had asked him <br />to show proof of homestead. Mr. Reyna stated he showed proof of homestead to Planning <br />and was still denied his permit. Mr. Jim Byrn addressed the Council and stated he <br />supported the City staff and commended them for making sure all the rules and <br />Ordinances were complied with. Mr. Byrn asked in the event someone does not comply <br />with the rules and they continue to build, was there some way they can be stopped from <br />continuing to build. Mr. Taylor stated there are some legal means such as Municipal Court <br />prosecution, the filing of charges for violating the Ordinance and it can draw a fine. Mr. <br />Taylor stated the other possibility is generally to try Municipal Court first and if that does <br />not work to go to District Court and possibly State County Court and get an injunction <br />against the violation. Mr. Taylor stated there are fines under the Ordinance and if an <br />injunction is not obeyed it can be punishable by jailing as well as by fines. Mr. RC. White <br />stated he lived at 110 Elm Court and stated the builders have gone through a lot of trouble <br />and expense to preserve the neighborhood. Mr. White stated he met Mr. Reyna and <br />noticed he kept cutting trees until every tree was cut on the lot and then scraping dirt and <br />has removed all vegetation. Mr. White stated Mr. Reyna has piled debris on a neighbor's <br />lot. Mr. White stated Mr. Reyna's landscaping includes what appears to be forms for <br />foundation for the garage and the main part of the lot seems to appear to have forms for <br />a foundation which has been filled with fill dirt of some kind. Mr. White stated the other <br />homeowners seem to care about the neighborhood and it seems Mr. Reyna does not. Mr. <br />White stated he is concerned about what is going to happen to the neighborhood and <br />wanted to let Council know they supported staff and their efforts. Mr. Guerra stated the <br />issue is the dissemination and collection of information. Mayor Pro-Tem Hernandez stated <br />there were some legal issue which needed to be addressed. Mr. Taylor stated his <br />involvement with the set of issues has been limited and consists of discussions with staff <br />and Mr. Reyna along the lines of we deal with Mr. Reyna as we do with any citizen who <br />comes in. Mr. Taylor stated the homestead exemption issue which is an exemption for <br />being licensed and in some respects is not much, is a payment of a fee only and there is <br />no bond and no exam. Mr. Taylor stated in respect to the electrical and plumbing license <br />there are rigorous examinations which need to be studied and passed before they can <br />issue a license for those. Mr. Taylor stated his advice has been as long as they are <br />applying the requirements in a uniform way then his advice to Mr. Reyna is he must follow <br />the requirements and his advice to Staff has been they can enforce the requirements as <br />long as there is uniform application. Mr. Guerra asked Mr. Gilley to identify outstanding <br />issues as they appear to him and staff. Mr. Gilley stated the issues are the licenses for <br />electrical and plumbing and Mr. Reyna had stated he had met with the Board of Appeals <br />and had been denied these licenses. Mr. Gilley stated Mr. Reyna had stated that in both <br />cases he just needed to show proof that was his homestead. Mr. Gilley stated he was not <br />sure whether this was the only thing which had occurred at the meeting. Mr. Gilley stated <br />Mr. Reyna had made efforts to make sure he obtained his homestead. Mr. Gilley stated <br />staff had not told Mr. Reyna they would not be able to permit him but they would review his <br />applications and make a determination. Mr. Gilley stated Mr. Reyna had been denied his <br />permits this afternoon and stated there have been a number of ongoing code violations. <br />Mr. Gilley stated Staff is willing to work and resolve these issues. Mr. Guerra stated given <br />Mr. Reyna was denied by the Board the staff is prepared to work with him to resolve those <br />two issues and whether or not Mr. Reyna likes how we get there is another issue. Mr. <br />Patterson and his staff continue to be prepared to work with Mr. Reyna. Mr. Hernandez <br />told Mr. Reyna, Mr. Guerra was trying to get an assurance from Council's part to try to work <br />with the Staff, Mr. Reyna and the neighbors and there is a willingness to try to work through <br />
