Mr. Hart stated he would admit the City's system is not perfect and the process is not and it is also not political. Mayor Pro-Tem Hernandez introduced the City Manager's Report. Mr. Gilley had no report at this meeting. Mayor Pro-Tem Hernandez introduced the City Attorney's Report. Mr. Taylor had no report at this meeting. Mayor Pro-Tem Hernandez introduced the City Council's Report. (1) Mr. Guerra stated he had received a call from the City of Marshall and wanted to know if the Council had received anything regarding the issue and support of the Eagle. Mr. Guerra stated the Mayor of Marshall had informed him all the cities had responded except the City of San Marcos. Mr. Taylor stated a Resolution has been passed and they are struggling for ongoing funding for another time period and he has not seen anything in six months from the City of Marshall. Mr. Gilley stated he would be sending Mr. Guerra some information he received about service being discontinued some time in May. (2) Mayor Pro-Tem Hernandez informed the Council the heavy rains have caused some flooding from curb to curb at Sunset Acres. Mayor Pro-Tem Hernandez stated there are five houses on Parkdale where drainage is still a problem with the heavy rains.' Mr. Gilley stated Engineering is conducting an analysis to determine cause and when determined will work on a solution. Mayor Pro-Tem Hernandez introduced an Executive Session pursuant to the Government Code, Chapter 551.071, to discuss pending litigation (Saenz v. Diamond Shamrock Co.) and matters where the City Attorney's ethical duty to the City clearly conflicts with Government Code Chapter 551 (development incentive proposals- Posey Road and Municipal Airport; canvass of May 3, 1997 election returns); and Section 551.074, to discuss duties of a public employee (City Secretary). Mr. Guerra moved to adjourn into Executive Session at 10:58 p.m. and Ms. Hughson seconded the motion, which passed unanimously. Mr. Hart not present. Mr. Mihalkanin moved to reconvene at 11 :36 p.m. and Ms. Hughson seconded the motion which passed unanimously.
