Page 4 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br /> CITY BY REZONING LOT 11, SOUTHEND ADDITION LOCATED AT 4089 <br /> RAILROAD STREET FROM "M" SINGLE-FAMILY DUPLEX AND <br /> NEIGHBORHOOD BUSINESS DISTRICT TO "R-2" SINGLE-FAMILY <br /> DWELLING DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL <br /> PROVISIONS; AND PROVIDING FOR PENAL TIES. <br />Mayor Pro-Tem Hernandez opened the public hearing and asked if anyone wished to <br />speak. No one did so Mr. Hernandez closed the public hearing. Mr. Cox moved for <br />approval of the Zoning Ordinance and Ms. Hughson seconded the motion which passed <br />unanimously. Mr. Guerra was not present to vote. <br /> Mr. Hernandez introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br /> CITY BY REZONING A 4.14 ACRE TRACT OF PROPERTY LOCATED AT <br /> THE INTERSECTION OF STAGECOACH ROAD AND HUNTER ROAD <br /> FROM "TH-2" TOWNHOUSE RESIDENTIAL DISìRICT (MEDIUM <br /> DENSITY) AND "C" COMMERCIAL DISTRICT TO "C" COMMERCIAL <br /> DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br /> FOR PENALTIES. <br />Mayor Pro-Tem Hernandez opened the public hearing and asked if anyone wished to <br />speak. Mr. Guerra not present to vote. <br /> i <br /> Mayor Pro-Tem Hernandez introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 86.197 OF THE CITY CODE TO <br /> REVISE DEPOSIT POLICIES FOR ELECTRIC, WATER AND SEWER <br /> SERVICE TO ALLOW FOR CREDIT REFERENCE LETTERS FROM <br /> OTHER UTILITIES IN LIEU OF DEPOSITS AND TO REVISE PAYMENT <br /> HISTORY TIME PERIODS; INCLUDING PROCEDURAL PROVISIONS; <br /> AND PROVIDING FOR PENAL TIES. <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading and Mr. Hart seconded <br />the motion. Ms. Hughson asked on 86.197(b) if someone had been a utility customer <br />without any problems for less than a year and they moved would this still require a second <br />deposit or could they transfer. Mr. Gilley stated if they had a deposit currently at one <br />location and they move to another location, and provided they have not met the criteria for <br />waiver of their deposit, they would be required to pay a second deposit and it would be <br />credited on their next bill. Ms. Hughson stated she had another question on (e)(1). Ms. <br />Hughson asked if the deposit is refunded at the time of termination of service as it says or <br />what Mr. Gilley stated earlier, and Mr. Gilley stated it is soon thereafter and the subsection ¡ <br />will need to be reworded. On Sec. (e)(2) Ms. Hughson asked when a refund for the deposit <br />is entered as credit or refunded by check does it occur automatic or by request. Mr. Bob t <br />Higgs stated it would be automatic. Mr. Higgs stated he would check whether it was being <br />done currently. Mr. Higgs stated it would take a manual process from the time the <br />computer kicks it out to write the check. Ms. Hughson stated as far as the citizen is <br />concerned it is not done automatically. Mr. Higgs stated that was correct. Mr. Higgs stated <br />they do credit the account and the customer usually requests it be done. Ms. Hughson <br />stated she would feel better if it was changed to 24 months instead of 12 and she did not <br />particularly care for the letter of credit from somewhere else. Ms. Hughson moved to <br />amend (b) by replacing 12 to 24 months and 1 year to 2 years and to delete (b)(3) and <br />
