Mr. Taylor suggested an amendment be made to the recital to <br />incorporate a reference to the November 26, 1996 Planning and Zoning Commission <br />meeting where some of the provisions of this Ordinance were debated and a public hearing <br />was held in addition to the public hearing of January 21st. Ms. Hughson made a motion <br />on Mr. Taylor's suggestion and Mr. Hart seconded the motion which passed ùnanimously. <br />On roll call adoption of the Ordinance passed unanimously. <br />Mayor Pro-Tem Hernandez introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AWARDING A CONTRACT FOR JANITORIAL SERVICES TO <br />AMERICAN MAID SERVICE; AUTHORIZING THE PURCHASING <br />MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF OF THE <br />CITY; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Cox moved for adoption of the Resolution and Mr. Mihalkanin seconded the motion <br />which passed unanimously. <br />Mayor Pro-Tem Hernandez introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LETTER <br />AGREEMENT BETWEEN THE CITY AND GILLAND LAWN SERVICE TO <br />EXTEND THE TERM OF THE LANDSCAPE MAINTENANCE CONTRACT; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT <br />ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br />Mr. Guerra moved for adoption of the Resolution and Mr. Mihalkanin seconded the motion <br />which passed unanimously. Mr. Hart not present to vote. <br />Mayor Pro-Tem Hernandez introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN'MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LETTER <br />AGREEMENT BETWEEN THE CITY AND THE UPPER SAN MARCOS <br />WATERSHED RECLAMATION AND FLOOD CONTROL DISTRICT FOR <br />ACCESS FROM A PUBLIC ROADWAY TO A PARCEL OF PROPERTY <br />OWNED BY THE DISTRICT; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Cox moved for adoption of the Resolution and Mr. Mihalkanin seconded the motion. <br />Mr. Guerra asked if this was the most effective way to get this done. Mr. Taylor stated he <br />was not very familiar with the layout but this was requested by Mr. Bill Taylor and the <br />Watershed District so he assumed Mr. Taylor knows the best way. Mr. Bill Taylor stated <br />the District had not asked for this but rather for permanent access, and he will try to get this <br />through his board and see if it will work. Mr. Taylor stated they are approximately 125 feet <br />from the dam site from a public roadway which goes through property he understands is <br />park property and is unused at this time. Mr. Taylor stated it would be used occasionally <br />for purposes of inspection and maintenance of the dam site. Mr. Taylor stated the <br />easement is owned by the District but the property is not. Mr. Taylor stated the access <br />easement the District has now which was requested by the Soil Conservation Service <br />years ago is practically unusable in a time of flood, and basically it was requested for <br />access during construction. Mr. Taylor stated at the present they are in the process of <br />replacing access easements throughout the District. Mr. Taylor stated he had requested <br />permanent access rather than 20 years since they cannot rescind the existing easement <br />unless they have a permanent easement and does not think the Natural Resources <br />
