Mr. Guerra moved for adoption of the Zoning <br />Ordinance and Ms. Hughson seconded the motion, which passed unanimously. <br />Mayor Moore introduced a public hearing and approval of an Ordinance on first reading, the <br />caption which was read as follows: <br />AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 114, ZONING, OF THE SAN MARCOS CITY <br />CODE TO ADD A NEW C-2 HEAVY COMMERCIAL ZONING DISTRICT AND TO <br />DEFINE PERMITTED AND SPECIFIC USES FOR THE DISTRICT, TO REVISE THE <br />"P" PUBLIC AND INSTITUTIONAL DISTRICT TO CHANGE <br />TELECOMMUNICATION TOWERS FROM PERMITTED TO SPECIFIC USES, TO <br />DELETE FUNERAL HOMES AS PERMITTED USES N "LB" LIMITED BUSINESS <br />DISTRICTSAND ADDING THEM AS PERMITTED USES N "C" COMMERCIAL <br />DISTRICTS, TO DELETE HOSPITALS AS SPECIFIC USES N "LB" LIMITED <br />BUSINESS DISTRICTS, TO DELETE MINI-WAREHOUSES, CERTAIN RETAIL <br />AND SERVICE USES, AND COMMERCIAL CAMPGROUNDS AND <br />RECREATIONAL VEHICLE PARKS AS PERMITTED USES N "C " COMMERCIAL <br />DISTRICTS, TO REVISE PERMITTED USES N "C" COMMERCIAL DISTRICTS, <br />TO REVISE PERMITTED USES AND SETBACK REQUIRBMENTS N "LI" LIGHT <br />INDUSTRIAL DISTRICTS, TO ADD PLANNED INDUSTRIAL PARKS AS <br />SPECIFIC USES N "LI" LIGHT INDUSTRIAL DISTRICTS, AND TO REVISE <br />PERMITTED USES N "I" INDUSTRIAL DISTRICTS; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. No one did so <br />Mayor Moore closed the public hearing. Ms. Hughson moved for approval of the Ordinance on <br />first reading and Mr. Mihalkanin seconded the motion. Mr. Patterson stated these changes came <br />about by the business community. The Chamber of Commerce assisted the City by organizing a <br />group of business owners to look at some of the uses for the Light Industrial District and make <br />some objectionable uses to other categories. One suggestion was to create a heavy commercial <br />district for objectionable uses to fit into. Also the changes will allow the telecommunications <br />towers by right in the Industrial and Light Industrial Districts and to create a specific use permit <br />process. Ms. Hughson asked what the new Commercial District was going to be called in the <br />future. Mr. Patterson stated "C-2". Mr. Hart asked the procedure of implementation once the <br />changes are made and where does "C-2" fit in the process. Mr. Patterson stated "C-2" would be <br />between Commercial and Light Industrial Districts. He stated implementation would be <br />administered beginning with businesses currently in place which could legally continue their <br />businesses under the current usage. Mr. Patterson stated new businesses would need to be <br />notified they would have to be rezoned to "C-2" and be informed of the zoning process. Mr. Hart <br />asked if this was part of the Master Plan and Mr. Patterson stated that was correct. Mr. Guerra <br />asked Mr. Patterson to provide the Council with information to obtain public input regarding the <br />telecommunications bill at the next Council meeting. The Council then voted unanimously for <br />approval of the Ordinance of first reading. <br />Mayor Moore introduced for consideration approval of an Ordinance on first reading, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />t TEXAS, AMENDING SECTION 42.051 OF THE CITY CODE TO REVISE THE <br />QUALIFICATIONS FOR MEMBERSHIP ON THE HISTORIC PRESERVATION <br />COMMISSION; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br />Mr. Guerra moved for approval of the Ordinance on first reading and Ms. Hughson seconded the <br />motion. Mayor Moore asked why this change was being requested. Ms. Womack stated this <br />request was due to the limitation of people available in the architecture and design field of <br />expertise position. The Council then voted unanimously for approval of the Ordinance on first <br />reading.
