27 <br />Regular Meeting February 24, 1997 Page 2 <br />Mayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAM MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDNANCE FOR THE 1996-97 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE SUNSET ACRES UTILITY <br />IMPROVEMENTS PROJECT AND DECLARING AN EMERGENCY- - <br />Mr. Cox moved for adoption of the Ordinance on emergency and Mr. Hernandez seconded the <br />motion. Ms. Hughson asked where the dirt was going to be placed. Mr. Jenkins stated in a pit <br />on River Road or on City property for future use. Ms. Hughson also asked why this was <br />considered an emergency. Mr. Gilley stated the Senior Citizens Housing Center requested this <br />be removed as soon as possible. Mr. Hart asked why the contractor no longer wanted the dirt for <br />fill material. Mr. Gilley stated the contractor felt the dirt had become contaminated. The <br />Council then voted unanimously for adoption of the Ordinance on emergency. <br />Mayor Moore introduced for consideration approval of an Ordinance on first reading, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 2.484 OF THE SAN MARCOS CITY CODE AND <br />ADOPTING A REVISED PUBLIC INFORMATION FEE SCHEDULE; INCLUDING <br />PROCEDURAL PROVISIONS AND PROVIDING FOR PENALTIES. <br />Mr. Hernandez moved for approval of the Ordinance on first reading and Mr. Hart seconded the <br />motion. Ms. Hughson stated some of the fees were too high and would like to amend. Mr. <br />Mihalkanin agreed. Ms. Womack stated this Ordinance was to conform with State Law to <br />charge for copies only and not for research involved. Mr. Taylor stated the certified copies were <br />generally for business purposes and the non-certified copies were cheaper rates. Ms. Hughson <br />withdrew her amendment. The Council then voted unanimously for approval of the Ordinance <br />on first reading. Mayor Moore requested the fees be made available in the Lobby at City Hall. <br />Ms. Hughson requested a statement be placed on the fee form stating non-certified copies were <br />available. <br />Mayor Moore introduced for consideration reconsideration of two Zoning Ordinances. No one <br />wished to reconsider the Ordinances, the captions read as follows: <br />AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 10.73 ACRE TRACT OF PROPERTY LOCATED N THE 1300 BLOCK OF RIVER <br />ROAD FROM "R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) <br />AND "C" COMMERCIAL DISTRICT TO "P" PUBLIC AND INSTITUTIONAL <br />DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 0.5 ACRE TRACT OF PROPERTY LOCATED AT 405 MILL STREET FROM "M" <br />SINGLE-FAMILY, DUPLEX, AND NEIGHBORHOOD BUSINESS DISTRICT (LOW <br />DENSITY) TO "R-1" SINGLE-FAMILY RESIDENTIAL DISTRICT (LOW _ <br />DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />Mayor Moore introduced for consideration approval of minutes of the Regular Meeting held <br />February 10, 1997, approval of minutes of the emergency meetings held February 11, 1997 and <br />February 12, 1997, adoption of an Ordinance on third and final reading, and adoption of ten <br />Resolutions on consensus. Ms. Hughson removed items 9.C.(1), 9.C.(2), 9.C.(3), 9.C.(4), <br />9.C.(6), 9.C.(7), and 9.C.(9), adoption of Resolutions to be considered separately. Mr. Hart
