8 Regular Meeting June 9, 1997 Page 7 Mr. Guerra moved for approval of the Ordinance on third and final reading and Ms. Hughson seconded the motion which passed unanimously. (Mr. Guerra not present to vote.) Mayor Moore introduced for consideration removal from the table and adoption of an ordinance on third and final reading, the caption which was read as follows:' I? AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN I MARCOS, TEXAS, CREATING A BIRD SANCTUARY, REGULATING CONDUCT IN CITY PARKS, BROADENING PARK RANGER AUTHORITY, AND DELEGATING AUTHORITY TO SET CERTAIN PARK USE FEES TO THE CITY MANAGER OR PARKS AND RECREATION DIRECTOR, BY AMENDING CHAPTER 58- PUBLIC FACILITIES, PARKS AND RECREATION, SECTIONS 58.026, 58.030, 58.032, 58.036 AND ADDING SECTIONS 58.037, 58.038, 58.039, 58.040, 58.041 AND 58.070; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Ms. Hughson moved to remove the ordinance from the table and to approve it on third and final reading and Mr. Mihalkanin seconded the motion. Ms. Hughson stated it would be good to reference State law in the ordinance and for there to be a reference. Mr. Taylor stated the City is going well beyond State law and it permits hunting of game birds. Mr. Taylor stated the City will not permit hunting of any bird in the City. Mr. Taylor stated: he would like to do a more involved comparison. Mr. Hart then moved to table the ordinance and Mr. Hernandez seconded the motion. On roll call, the following vote was recorded: AYE: Cox, Hernandez, Hughson, Hart, NAY: Mihalkanin, Moore (Mr. Guerra not present to vote.) Mayor Moore introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AWARDING A CONSTRUCTION CONTRACT FOR THE WASTEWATER TREATMENT SLUDGE PROCESSING FACILITIES PROJECT TO BRYAN CONSTRUCTION COMPANY, INC.; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. Mr. Hernandez moved for adoption of the Resolution and Mr. Cox seconded the motion, which passed unanimously. Mayor Moore introduced for consideration adoption of a Resolution, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING CONTRACT AMENDMENT NO. 3 TO CONTRACT NO. 703162 BETWEEN THE CITY AND THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS FOR A GRANT TO ESTABLISH A SMALL BUSINESS INCUBATOR IN SAN MARCOS; AUTHORIZING THE MAYOR TO EXECUTE THE AMENDMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. Mr. Cox moved for adoption of the Resolution and Mr. Mihalkanin seconded the motion which passed unanimously. (Mr. Hart and Mr. Guerra not present to vote.)
