Mr. Gilley stated the Ordinance allows businesses 90 <br />days per calendar year. (4) Mr. Mihalkanin stated he would like to <br />see businesses leave the right to sell food outside their store in <br />certain locations. He requested this be investigated. , <br />Mayor Moore introduced for consideration an Executive Session <br />pursuant to Government Code, Section 551.071, to discuss pending <br />litigation (NBS Contruction vs. City of San Marcos; Jimmy Brown vs. <br />Albert Armstead, Et Al) and matters where the City Attorney's <br />ethical duty to the City clearly conflicts with Government Code <br />Chapter 551 (development incentive proposal - Conway Addition; <br />Gonzales Enterprises, Inc., judgment lien). Mr. Mihalkanin moved to <br />adjourn into Executive Session at 10:49 p.m. and Mr. Hart seconded <br />the motion, which passed unanimously. <br />Mr. Mihalkanin moved to reconvene from Executive Session at 11:18 <br />p.m. and Ms. Hughson seconded the motion, which passed unanimously. <br />The meeting adjourned at 11:21 p.m. on motion made by Mr. Mihalkanin <br />and seconded by Mr. Hernandez. <br /> <br />Ronald K.
