Mr. Cox moved for approval of the Ordinance on first reading and Mr. ~~ ¡ Mihalkanin seconded the motion, which passed unanimously. Mayor Moore introduced for consideration approval of Minutes of the Regular Meeting held June 23, 1997. Mr. Guerra moved for approval of the Minutes and Mr. Mihalkanin seconded the motion, which passed unanimously. Mayor Moore introduced for consideration approval of an Ordinance on second readirtg, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 14, BUILDINGS AND BUILDING REGULATIONS, OF THE SAN MARCOS CITY CODE TO PROVIDE FOR RENEWAL OF CITY MECHANICAL CONTRACTOR LICENSES FOR A DEFINED TIME PERIOD¡ INCLUDING PROCEDURAL PROVISIONS¡ AND DECLARING AN EFFECTIVE DATE. . Ms. Hughson moved for approval of the Ordinance on second reading and Mr. Hart seconded the motion, which passed unanimously. Mayor Moore introduced for consideration approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ADDING TWO POLICE OFFICER POSITIONS IN THE POLICE DEPARTMENT IN ACCORDANCE WITH SECTION 2.373 OF THE SAN MARCOS CITY CODE AND SECTION 143.021 OF THE LOCAL GOVERNMENT CODE¡ AMENDING THE TABLE OF POLICE POSITIONS MAINTAINED IN THE CITY SECRETARY'S OFFICE TO REFLECT THIS RECLASSIFICATION¡ AMENDING THE 1996-97 BUDGET TO PROVIDE FUNDING FOR ADDITIONAL POLICE VEHICLES¡ AND INCLUDING PROCEDURAL PROVISIONS. Mr. Guerra moved for approval of the Ordinance on second reading and Mr. Hernandez seconded the motion, which passed unanimously. Mayor Moore introduced for consideration approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 74, ARTICLE 3 - SIDEWALKS, BY ADDING REGULATIONS REGARDING TREES, PLANTS, FENCES, STREETS AND SIDEWALKS IN CITY RIGHTS-OF-WAY¡ INCLUDING PROCEDURAL PROVISIONS¡ AND PROVIDING FOR PENALTIES. Ms. Hughson moved for approval of the Ordinance on second reading and Mr. Mihalkanin seconded the motion. Mr. Guerra asked if he could put up a short white picket fence, and Mr- Gilley stated if it is under four feet. Mr. Hart stated there are many cracked sidewalks referring to Section 74.122. Mr. Taylor stated he will work on amended language for this section, as it is intended to deal with cracked sidewalks that endanger people. Ms. Hughson stated if it is unlawful what is the penalty, and Mr. Taylor stated there is a penalty clause which would allow us to communicate the nature of the penalty clause to the violator and can file charges against the violator in Municipal Court up to $500.00 for this type violation. The Council voted unanimously for approval of the Ordinance on second reading (Mr. Guerra not present to vote on this item) . Mayor Moore introduced for consideration adoption of a Resolution, the caption which was read as follows:
