NIr. Hart moved for approval of the Ordinance on first reading and INIs. Hu;hson seconded the motion, which passed unanimously. Mayor Moore introduced for consideration removal from the table and adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CREATING A BIRD SANCTUARY, REGULATING CONDUCT IN CITY PARKS, BROADENING PARK RANGER AUTHORITY, AND DELEGATING AUTHORITY TO SET CERTAIN PARK USE FEES TO THE CITY MANAGER OR PARKS AND RECREATION DIRECTOR, BY AMENDING CHAPTERS 6 - ANIMALS AND 58 PUBLIC FACILITIES, PARKS AND RECREATION, SECTIONS 58.026, 58.030, 58.032, 58.036 AND ADDING SECTIONS 6.012, 58.037, 58.038, 58.040 AND 58.070; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Ms. Hu?hson moved to remove from the table and adoption of the Ordinance as amended and NIr. Mihalkanin seconded the motion, which passed unanimously. Mayor Moore introduced for consideration reconsideration of a Zoning Ordinance. No one wished to reconsider the Ordinance, the caption reads as follows: AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDNG THE OFFICIAL ZONING MAP OF THE CITY BY REZONNG A 12.0 ACRE TRACT OF PROPERTY LOCATED N THE 1200 BLOCK OF LEAH DRIVE NEAR ITS INTERSECTION WITH WONDER WORLD DRIVE FROM " NIF- 5" MULTI-FAMILY DWELLING DISTRICT (HIGH DENSITY), "C" COMMERCIAL DISTRICT AND-LB" LIMITED BUSINESS DISTRICT TO "C" COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS AND PROVIDING FOR PENALTIES. Mayor itiloore introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A LOAN GUARANTEE AGREEMENT BETWEEN THE CITY AND THE TEXAS DEPARTMENT OF TRANSPORTATION FOR CONTINUATION OF THE TEXAS EAGLE PASSENGER TRAIN SERVICE BY ANITRAK; AND DECLARL,iG AN EFFECTIVE DATE. y1r. Guerra moved for adoption of the Resolution and,\/fr. Cox seconded the motion. Mr. Hart asked if the city had a continuous liability of S26,000. Mr. Gilley stated yes until December 1998 when the debt would be paid. vls. Hu;hson asked if the city was obligated to fund this and NIr. Taylor stated no.
