3 <br />Regular Meeting August 11, 1997 Page 3 <br />looked forward to the next staff presentation and public hearing. Ms. Hughson moved to amend <br />the plan to replace Dorrie Miller with Doris Miller throughout the document and Mr. Hernandez <br />seconded the motion, which passed unanimously. The Council then voted unanimously for <br />approval of Sector One Plan on first reading. <br />Mayor Moore introduced for consideration an Ordinance on emergency, the caption which was <br />read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 38-FIRE PREVENTION AND PROTECTION BY <br />DECLARING THE SALE, POSSESSION, STORAGE, DISCHARGE, OR OFFER FOR <br />SALE OF FIREWORKS A PUBLIC NUISANCE WITHIN THE CITY OR WITHIN <br />5,000 FEET OF THE CITY LIMITS; INCLUDING PROCEDURAL PROVISIONS; <br />AND PROVIDING FOR PENALTIES AND DECLARING AN EMERGENCY. <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Mr. Hart seconded the <br />motion, which passed unanimously. <br />Mayor Moore introduced for consideration approval of an Ordinance on second reading, the <br />caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, INCREASING THE RESIDENTIAL SOLID WASTE COLLECTION RATE; <br />AND INCLUDING PROCEDURAL PROVISIONS AND DECLARING AN <br />EFFECTIVE DATE. <br />Mr. Guerra stated he had a direct conflict of interest and filed a disclosure affidavit. Mr. Guerra <br />left the Council Chambers. Mr. Hernandez moved fcrr approval of the Ordinance on second <br />reading with an amendment to Section 1. to read $11.46 and Mr. Hart seconded the motion. <br />Ms. Hughson stated we could have saved the City $.74. On roll call the following vote was <br />recorded: (Mr. Guerra not present for roll call). <br />AYE: Mihalkanin, Hart, Moore, Hernandez. <br />NAY: Hughson. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration reconsideration of two Zoning Ordinances. No one <br />wished to reconsider the Ordinances; the captions read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 1.54 ACRE TRACT OF PROPERTY LOCATED IN THE 2200 BLOCK OF LEAH <br />AVENUE NEAR ITS INTERSECTION WITH WONDER WORLD DRIVE FROM <br />"MF-5" MULTI-FAMILY DWELLING DISTRICT (HIGH DENSITY) TO "C" <br />COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 4.724 ACRE TRACT OF PROPERTY LOCATED AT 500 CARLSON CIRCLE <br />FROM "PUD" PLANNED UNIT DISTRICT TO "LI" LIGHT INDUSTRIAL <br />DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />Mayor Moore introduced for consideration approval of the minutes of the Regular :Meeting held <br />July 28, 1997, approval of three Ordinances on second reading, adoption of three Ordinances on <br />third and final reading and adoption of a Resolution, on consensus.
