Ms. Hughson moved to amend the plan to replace Dorrie Miller with Doris Miller throughout the document and Mr. Hernandez seconded the motion, which passed unanimously. The Council then voted unanimously for approval of Sector One Plan on first reading. Mayor Moore introduced for consideration an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 38-FIRE PREVENTION AND PROTECTION BY DECLARING THE SALE, POSSESSION, STORAGE, DISCHARGE, OR OFFER FOR SALE OF FIREWORKS A PUBLIC NUISANCE WITHIN THE CITY OR WITHIN 5,000 FEET OF THE CITY LIMITS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES AND DECLARING AN EMERGENCY. Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Mr. Hart seconded the motion, which passed unanimously. Mayor Moore introduced for consideration approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, INCREASING THE RESIDENTIAL SOLID WASTE COLLECTION RATE; AND INCLUDING PROCEDURAL PROVISIONS AND DECLARING AN EFFECTIVE DATE. Mr. Guerra stated he had a direct conflict of interest and filed a disclosure affidavit. Mr. Guerra left the Council Chambers. Mr. Hernandez moved fcrr approval of the Ordinance on second reading with an amendment to Section 1. to read $11.46 and Mr. Hart seconded the motion. Ms. Hughson stated we could have saved the City $.74. On roll call the following vote was recorded: (Mr. Guerra not present for roll call). AYE: Mihalkanin, Hart, Moore, Hernandez. NAY: Hughson. No one wished to reconsider the Ordinances; the captions read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 1.54 ACRE TRACT OF PROPERTY LOCATED IN THE 2200 BLOCK OF LEAH AVENUE NEAR ITS INTERSECTION WITH WONDER WORLD DRIVE FROM "MF-5" MULTI-FAMILY DWELLING DISTRICT (HIGH DENSITY) TO "C" COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 4.724 ACRE TRACT OF PROPERTY LOCATED AT 500 CARLSON CIRCLE FROM "PUD" PLANNED UNIT DISTRICT TO "LI" LIGHT INDUSTRIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES.
