5 <br />Regular Meeting August 11, 1997 Page 5 <br />and Mayor Moore agreed. Ms. Hughson explained the At-Large position was put in place for <br />interested citizens which did not fit into other categories. Ms. Hughson stated she would like to <br />see three individuals remain on the Hospitality Association; however, would agree to change to <br />Hospitality Industry. Mr. Hernandez restated his motion to delete one member of the Hospitality <br />Association and change Association to Industry and delete the Neighborhood Association <br />Member and Mr. Hart seconded the motion. On roll call the following vote was recorded: <br />AYE: Mihalkanin, Hart, Moore, Guerra, Hernandez. <br />NAY: Hughson. <br />ABSTAIN: None. <br />Mr. Mihalkanin moved to amend Section 2.351(a) to read fifteen voting members and (e) to read <br />ten members reside within the city limits and five outside and Mr. Hernandez seconded the <br />motion, which passed unanimously. Mr. Mihalkanin moved to amend Section 2.351(a) to read as <br />follows: "... and four non-voting ex-officio members, the City Manager, the President of the <br />San Marcos Area Chamber of Commerce and a Vice-Chair and the..." and Mr. Hernandez <br />seconded the motion. Ms. Hughson suggested putting that information in the contract rather than <br />the Ordinance. On roll call the following vote was recorded: <br />AYE: Mihalkanin, Moore, Guerra, Hernandez. <br />NAY: Hughson, Hart. <br />ABSTAIN: None. <br />On roll call for approval of the Ordinance on secon&reading, the following vote was recorded: <br />AYE: Mihalkanin, Hart, Moore, Guerra, Hernandez. <br />NAY: Hughson. <br />ABSTAIN: None. <br />Mayor Moore introduced Item 10.B.(3), removed for the consensus agenda, approval of an <br />Ordinance on second reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 82.159 OF THE CITY CODE TO REMOVE THE <br />DISCOUNT FOR EARLY PAYMENT OF OVERTIME PARKING VIOLATION <br />FINES; AND INCLUDING PROCEDURAL PROVISIONS. <br />Mr. Guerra moved for approval of the Ordinance on second reading and Mr. Mihalkanin <br />seconded the motion. Ms. Hughson asked what the statistics were on individuals paying their <br />fines in three days. Mr. Gilley stated for a thirteen month period 1,392 parking tickets were <br />issued and 62% paid within two to three days. Mayor Moore stated he was concerned with <br />tourists being fined and would like to amend the Ordinance to 1 day $5.00, 3 days $10.00 and 5 <br />days or more $20.00 and Mr. Hernandez seconded the motion. On roll call the following vote <br />was recorded: <br />AYE: Moore, Hernandez. <br />NAY: Mihalkanin, Hughson, Hart, Guerra. <br />ABSTAIN: None. <br />Motion fails. The Council then voted for approval of the Ordinance on second reading. On roll <br />call the following vote was recorded:
