City Council Meeting Minutes July 19,2016 <br /> 2. Consider adoption or direction to Staff on matters discussed in Executive Session. <br /> The Council reconvened at 6:11 p.m. The Council provided direction to Staff in <br /> Executive Session. No further action was taken. <br /> PRESENTATIONS <br /> 3. Receive a Staff presentation and hold discussion regarding the regulation of Short <br /> Term Rentals, and provide direction to Staff. <br /> Abigail Gillfillan, Planning Manager, provided the Council with a presentation <br /> regarding short term rentals (STR) in San Marcos. Discussion was held <br /> regarding the creation of a new STR Ordinance that is separate from the <br /> Nuisance Abatement Ordinance. <br /> The following direction was provided: <br /> In residential areas with permanent resident occupied <br /> Limited Use - If permanent resident is on the property they will have to <br /> register and pay HOT Tax. The number of occupants will be limited to 2 <br /> adults per bedroom +4. <br /> Staff to bring back suggestions regarding which zoning district would allow <br /> STR. <br /> In residential areas with no permanent resident <br /> Limited Use - They will have to register and pay HOT Tax. Allowed only if the <br /> owner lives in the city limits or ETJ, with a limit of one STR per owner with <br /> review in a year. <br /> Staff to publish the list of registered properties on the City's website. The <br /> number of occupants will be limited to two adults per bedroom +4. <br /> Staff to bring back recommendations related to number of occupant <br /> limitations. <br /> Staff will bring back a discussion regarding Bed and Breakfast regulation <br /> requirements of a conditional use permit. <br /> In commercial areas with or without a permanent resident <br /> By right use, but they will have to register and pay HOT Tax.The number of <br /> occupants will be limited to two adults per bedroom +4. <br /> Council provided consensus to review the ordinance in a year following its <br /> City of San Marcos Page 2 <br />
