19 <br />Regular Meeting August 25, 1997 Page 6 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, INCREASING WATER AND WASTEWATER <br />RATES ESTABLISHED UNDER SECTIONS 86.231 AND 86.262, <br />RESPECTIVELY, OF THE SAN MARCOS CITY CODE; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br />Mayor Pro Tern Hart opened the public hearing and asked if anyone wished to speak. <br />There were no other speakers so Mayor Pro Tern Hart closed the public hearing. Mr. <br />Hernandez moved approval of the Ordinance on first reading and Mr. Cox seconded the <br />motion which passed unanimously. <br />Mayor Moore introduced the reconsideration of a Resolution, the caption of which was read <br />as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE SALE OF A 61.23 ACRE <br />TRACT OF PROPERTY LOCATED ADJACENT TO THE HAYS <br />COUNTY CIVIC CENTER BY HAYS COUNTY, TRUSTEE; AND <br />DECLARING AN EFFECTIVE DATE. <br />Mayor Moore informed the Council that Judge Etheredge had signed the easement related <br />to the theater complex and had fled a copy with the City although he was reluctant at one <br />time because of the City's reluctance in unifying the drainage and infrastructure <br />improvements. Mayor Moore stated that Judge Etheredge had advised him this property <br />had been off the tax rolls for eight years and the accumulated tax value was based on <br />commercial zoning which the County reversed to Agricultural Open Space. Mayor Moore <br />stated Judge Etheredge said that if the City left it at Commercial the taxes would have <br />been $8 million. Mayor Moore stated he had heard from the City's tax collection attorney <br />that if the City received better than 50% recovery on the piece of taxable property which <br />is not on the tax roll the City would be doing well. Mr. Hernandez stated he did not wish <br />to reconsider this item. Mr. Hart stated if the Appraisal District thought the property was <br />worth $277,000 and the City would soon have a road to the property his position would <br />remain the same. The Council agreed by consensus not to take any action on this item. <br />Mayor Moore introduced for consideration the consent agenda, including the approval of <br />the minutes of the Regular Meeting held August 11, 1997, approval of one Ordinance on <br />second reading, adoption of an ordinance on third and final reading and nine resolutions; <br />approval for sale of City-owned property located on Shady Lane, and approval for <br />continuation of the Southwest Texas State University Police Department as a primary <br />public safety answering point under the Capital Area Planning Council's 9-1-1 Regional <br />Service Plan on consensus. The Council removed Item 8.B(2), approval of an Ordinance <br />on second reading, Item 8.C(1), adoption of an Ordinance on third and final reading; and <br />Item 8.D(9), adoption of a Resolution, to be considered separately. Mr. Mihalkanin moved <br />for approval of the minutes of the Regular Meeting held August 11, 1997, approval of one <br />Ordinance on second reading, adoption of an Ordinance on third and final reading and <br />adoption of the nine remaining Resolutions; approval for sale of City-owned property <br />located on Shady Lane, being a portion of the D.S. Combs Addition, Block 9, Lot 4; and <br />approval for continuation of the Southwest Texas State University Police Department as <br />a primary public safety answering point under the Capital Area Planning Council's 9-1-1 <br />Regional Service Plan on consensus. Mr. Hart seconded the motion which passed <br />unanimously. (Mr. Guerra abstained from Item 8.C(2) and filed an affidavit of conflict of <br />interest; Mr. Cox abstained from Item 8A because he was not present at the meeting and <br />Ms. Hughson voted nay on Item 8C.(2)).
