18 <br />Regular Meeting August 25, 1997 Page 5 <br />Commission which has issued an advisory opinion to Ms. Hughson and Mr. Cox that they <br />are not prohibited from voting on the adoption of the Sector 2 Plan because of their <br />ownership of homes in Sector 2. Mr. Cox stated he would be participating. Mayor Moore <br />made an introductory statement, explaning that there has been considerable controversy <br />generated with the adoption of the Sector 2 Plan. Mr. Ron Patterson presented the Sector <br />2 Plan and stated it is comprised of 815 acres located on the northwest side of town. Mr. <br />Patterson stated the Sector 2 Plan comprises 7% of the City's total land area and 8% of <br />its total population and includs the Oak Heights Neighborhood, Greater Castle Forest <br />Neighborhood which also includes Sendera and the Westover, Southwest Hills and Park <br />Place Neighborhoods. Mr. Patterson stated that the preparation of the future land use map <br />for Sector 2 has been highly controversial and it centers primarily on a 55 acre tract owned <br />by Dr. Jack Weatherford which is located at the corner of Ranch Road 12 and Bishop. Mr. <br />Patterson stated the controversy started before the Sector 2 process began because there <br />was a zoning change proposal on it that had a considerable number of apartments units <br />proposed. Mr. Patterson stated the case was withdrawn and the neighborhood has <br />consistently said that R-1 should remain entirely on that tract. Mr. Patterson stated the <br />Planning and Zoning Commission has recommended the corner area be designated as <br />mixed use with the strong suggestion that when it comes back to be zoned that it come <br />back as a Planned Development District which would have higher site planning required <br />so the neighborhood and the property owner would have some assurance as to what could <br />be placed there and what safeguards would be in place. Mayor Pro Tern Hart opened the <br />public hearing and asked if anyone wished to speak. Many citizens voiced their opinions <br />against the adoption of the Sector 2 Plan giving reasons such as traffic congestion, <br />increase in property values, concerns with the process, water pressure, the Council not <br />following the Master Plan, litter, noise and changing the single family zoning in this area. <br />Other citizens spoke in favor of the Plan because there is not much commercial <br />development and they did not feel there would be much of a change in traffic, it would meet <br />the needs of the community and the Plan has good professional planning guidelines. Mr. <br />and Mrs. Jack Weatherford, owners of the property gave a brief history of how all the <br />opposition began and the problems they are still facing now. Mr. Gilley gave a clarification <br />of the City's overlay program. Mr. Gilley stated the City has budgeted at least $100,000 <br />each year for the last ten years. Mr. John McBride stated the numbers he mentioned of <br />$32,000, 99,000 and 65,000 came from a memo presented to the Bond Committee from <br />George Boeker who stated that was what had been spent and that the rest had gone back <br />into the General Fund. There were no other speakers so Mayor Moore closed the public <br />hearing. Mayor Moore summarized Section 4-1 from the Sector 2 Document, the Future <br />Land Use Implementation Actions. Mr. Guerra moved to table the ordinance for further <br />discussion and Mr. Mihalkanin seconded the motion. The following vote was recorded: <br />AYE: Mihalkanin, Hart, Moore, Guerra, Cox <br />NAY: Hernandez <br />ABSTAIN: None <br />Mr. Guerra recommended that there be staff, Council, property owner and impacted <br />neighborhood involvement in a group discussion. Mr. Guerra stated that there is a need <br />for a facilitator to facilitate the discussion. Mr. Guerra suggested this issue be tabled and <br />brought back to Council in two weeks. Mr. Hart stated he did not feel another Sector 2 <br />Plan meeting would be fruitful because it is counterproductive when you have large number <br />of people with a different variety of interests . Mr. Hart stated having Mr. Patterson, Laura <br />Huffman and two or three designees of Castle Forest, Oak Heights and Hughson Heights <br />meet with the Weatherfords to have this group reach a compromise. Dr. Weatherford <br />stated the Council should work with staff but feels it is a waste of time for him to continue <br />to work with neighborhoods. Dr. Weatherford stated it would be a waste of time because <br />they have already stated their opposition. Mr. Hart stated he felt this was an issue which <br />could be resolved in a satisfactory manner. <br />Mayor Moore introduced for consideration a public hearing and adoption of an Ordinance <br />on first reading, the caption of which was read as follows:
