City Council Meeting Minutes October 18,2016 <br /> Absent: 1 - Mayor Guerrero <br /> 2. Consider adoption or direction to Staff on matters discussed in Executive Session. <br /> Council reconvened into open session at 6:10 p.m. Staff was provided direction <br /> in executive session. Council did not discuss the amendment to a Chapter 380 <br /> Economic Development Agreement with Humpty Dumpty SSM, Ltd. <br /> PRESENTATIONS <br /> 3. Receive a Staff presentation and hold discussion regarding the approval schedule and <br /> process for CodeSMTX, and provide direction to Staff. <br /> Abigail Gillfillan, Planning Manager, provided the Council with a presentation <br /> regarding the approval schedule and process for CodeSMTX. Staff will <br /> provide the Council with a list of the 8 areas that have already been addressed. <br /> Staff will provide the log of the comments received and the proposed text edits <br /> suggested. Council requested a letter from the Think Tank members regarding <br /> items that they may have wanted, but did not make it and concerns they feel <br /> may not be addressed in the code. Council would like their overall opinion. <br /> Staff will schedule joint City Council and Planning and Zoning Commission <br /> workshops to review the proposed code. <br /> 4. Receive a staff presentation and hold discussion regarding the regulation of short term <br /> rentals and other lodging uses, and provide direction to staff. <br /> Abigail Gillfillan, Planning Manager, provided the Council with a presentation <br /> regarding the regulation of short term rentals (STRs) and other lodging uses. <br /> Discussion was held regarding notification being provided up front on the <br /> virtual platform and a physical posting requirement within the rental <br /> providing evacuation route information from the flooded area, providing the <br /> lessee with a notice of potential hazard from flooding if the property is located <br /> in a flood hazard area. In regards to non-owner occupied properties Staff will <br /> mail notifications to both the property owner and the tenant at properties <br /> within 100 ft during the application process. Staff will also require a local <br /> contact for an STR that is not owner occupied. Staff will investigate multiple <br /> options in regards to area and location requirements and/or limitations for the <br /> number of STRs allowed in a single family neighborhood, and a method to help <br /> identify the types of STRs. The permit number would be included on any <br /> advertisement. Staff will address any enforcement and compliance issues <br /> during rental registration/nuisance abatement. Staff will provide fee <br /> recommendations during the first reading of the Ordinance. Staff will <br /> compare ordiannces regarding response time requirements for non-owner <br /> occupied STRs and whether the owner is required to respond or their designee. <br /> City of San Marcos Page 2 <br />
