<br />51 <br />Regular Meeting December 8, 1997 Page 2 <br />exceptions and simply does not want to see apartments built on this property. <br />Mayor Moore introduced a public hearing and approval of an Ordinance on second reading, the <br />caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 102.029 OF THE CITY CODE BY ADOPTING THE <br />SECTOR TWO PLAN; INCLUDING PROCEDURAL PROVISIONS; Al\ID <br />PROVIDING FOR PENALTIES. <br />Ms. Hughson stated she would be abstaining on this item because her homestead adjoins the <br />property most under controversy in Sector Two and removed herself from the Chambers. Mayor <br />Moore opened the public hearing and asked if anyone wished to speak. John McBride, of Oak <br />Heights Neighborhood, stated they opposed the plans of the charrette. He stated the City <br />currently has an award winning Master Plan comprised of the neighborhoods and they have <br />already determined their destiny. He felt an unwillingness of the Planning & Zoning <br />Commissioners and the City Council and stated they were being forced to accept something they <br />oppose. Mr. McBride stated the charrette agreed to 282 apartments which is only six less than <br />the original plan. He stated the majority of the development will be over the aquifer and felt <br />there is no consideration ofthe neighborhoods. He suggested Mr. Patterson's original plan with <br />density limitations, "LB", and "PDD" Districts. He thanked the Council and staff for their time <br />and effort for these considerations. Charles Swart, 1519 Ranch Road 12, stated he owns two <br />acres east of the church which is currently listed "low density". He stated the proposed plan is to <br />change to "medium density" and would like to urge the Council to remain "low density". Dr. <br />Jack Weatherford stated he has never opposed anyone's request for a zoning change. Jake Isaac, <br />Oaks Heights Neighborhood Association, stated he agreed to participate in the charrette and <br />recommended some amendments to Section 2. He stated he worked with Camille Phillips and <br />would like to propose the charrette be implemented through a "PDD". Larry Rasco, Oaks <br />Heights Neighborhood, stated they did not oppose the charrette; however, would like the Council <br />to consider the amendments submitted by Mr. Isaac. Dr. RF. Sowell, RR 12 and Bishop, stated <br />he was asked to participate in the charrette and was unable to because he was out of town. After <br />review of the plans, he would like to make the following recommendations: 1) stipulate "C" <br />development on Ranch Road 12 inward facing, 2) preservation of foliage and 3) "C" use <br />specified as "LB" or "PDD". If the land is sold as "C" would like a binding agreement to <br />develop as "LB". Carol Grimm, Oaks Heights Neighborhood, stated she represented her <br />neighborhood at the charrette and respects their concerns; however, she felt the seven resolutions <br />proposed in the charrette plan are viable. Rick Salas, Oak Heights Neighborhood Association, <br />stated he would like the Council to consider the amendments to the plan and felt there would be <br />more support from the neighborhood. He encouraged dialogue of charrette activity to continue in <br />the future. Dr. Weatherford suggested a modification to "PDD" by adding "or combination of <br />more specific zoning districts"; however, he is in favor of the charrette plan. There were no other <br />speakers so Mayor Moore closed the public hearing. Ron Patterson stated each neighborhood is <br />required to have 5% dedicated parkland and the charrette proposal has three acres. He stated as <br />far as the "drainage problem", the site must drain at no greater volume than prior to development. <br />Stephen Jenkins stated you could minimize the rate of run-off to predevelopment rate, such as <br />detention ponds and flow of runoff. Mr. Patterson stated the "water service" would be moving <br />forward with the easement and would access from the northwest which will improve the <br />pressure. Mr. Jenkins stated the "sewer" would be handled by the Sink Creek Interceptor and <br />"roads" would be curb cuts regulated by the State with limitations. Mr. Patterson stated what the <br />Council adopted will be part of the Master Plan. He stated currently there is 54 acres not zoned. <br />He stated the "infrastructure" is addressed in the zoning process. Mr. Cox asked about the <br />.inward facing commercial district. Mr. Patterson stated this was discussed and it was a <br />consensus to have two curb cuts with commercial development to be inward, but not specified. <br />He explained in an "LB" the developer would be an important part of the process for zoning and <br />classification. Mr. Cox asked if "LB" was an appropriate approach. Mr. Patterson agreed <br />explaining that "PDD" is a more cumbersome process and would tie down more issues and <br />concerns of all parties. Mr. Patterson stated the "PDD" process has been in place in San Marcos <br />for more than a decade. Mr. Guerra stated he would like to approve the Ordinance on second <br />reading as presented and consider all the proposals on third reading. Council agreed. Mr. <br />
