<br />24 <br />Regular Meeting November 24,1997 Page 2 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 102.029 OF THE CITY CODE BY ADOPTING THE <br />SECTOR TWO PLAN; INCLUDING PROCEDURAL PROVISIONS; PROVIDING <br />FOR PENALTIES AND DECLARING AN EMERGENCY. <br />Ms. Hughson stated her homestead adjoins the property most under controversy in Sector Two <br />and removed herself from the Chambers. Mr. Hart moved for adoption of the Ordinance on <br />emergency and Mr. Hernandez seconded the motion. Ron Patterson stated the charrette held on <br />Saturday was very successful and had a broad range of representation which included Joel <br />Barnard, Dr. Sally Caldwell, David Chiu, Carol Grimm, Russell Hamm, Ron Patterson, Scott <br />Polikov, Marty Sorrell, Dr. Jack Weatherford, Laura Weatherford and Sydney Weatherford, Dr. <br />Kent Butler, Milosav Cekic, Ross Frie, Laura de la Garza, Penny Keith and several neighborhood <br />residents. He stated two plans were developed; one by the landowner and one by the <br />neighborhood residents. He stated in the end they were surprisingly similar. Dr. Kent Butler, <br />Facilitator, stated the charrette is generally a brainstorm of ideas for focus on the community's <br />interest. He stated he was impressed how the two sides conversed and agreed on a mutual <br />decision. Dr. Butler stated the first thing the group did was create twelve guiding principals for <br />each side to follow. Then the two groups drew their designs and they began to combine the <br />ideas. Milosav Cekic, Architect, stated the two groups identified the needs of both views and <br />came to a mutual agreement which was beneficial to everyone involved. He stated the mixed <br />land use in this area would help keep the crime rate low because there would always be people in <br />the area at all hours of the day and night. Mr. Patterson stated he felt this was a worth while <br />process and felt it was important to have a good, vital, healthy community. He stated the land <br />use guidance is simply a tool for the future of the area and like any other land use or zoning <br />process, individuals could request a zoning change. Dr. Gilcrease stated he had two acres in this <br />area and was concerned about the effoce of the plan on his property. John McBride stated he did <br />not want the Council to take any action on the Ordinance until the neighborhoods had been <br />contacted. Carol Grimm stated she would like the Council to allow time for the neighborhoods <br />to view the proposal; however, she said she was willing to take the "heat" for the outcome of the <br />charrette since she had been a participant - not the City Council. Mark Rasco stated he attended <br />the charrette and although it is not exactly what he wanted for his neighborhood, it is an <br />acceptable compromise. Dr. Weatherford stated he understood the decision of the charrette <br />would be upheld by the City Council and he did not understand why it needed to be reconsidered <br />by the neighborhoods. He stated he would like the Council to have a majority vote and did not <br />feel it was fair to adopt on emergency. Laura Weatherford stated she felt the charrette was a <br />win-win situation for everyone involved and was very comfortable with the results. Dr: Stea, <br />SWT Planning Professor, stated he observed the charrette and was impressed with the entire <br />process and felt it was handled very professionally. Mr. Mihalkanin moved to table the <br />Ordinance and Mr. Cox seconded the motion. On roll call the following vote was recorded: <br />AYE: Mihalkanin, Moore, Guerra, Cox, Hernandez. <br />NAY: Hart. <br />ABSTAIN: Hughson. <br />Mr. Guerra clarified the Ordinance would be amended to three readings and would include the <br />recommendations of the charrette. He stated the first reading of the Ordinance would be on <br />December 1, 1997, the public hearing and second reading of the Ordinance would be on <br />December 8,1997, and adoption of the Ordinance on third and final reading would be at a <br />Special Meeting held on December 15, 1997. <br />Mayor Moore introduced for consideration reconsideration of a Zoning Ordinance. No one <br />wished to reconsider the Ordinance.
