<br />157 <br />Regular Meeting October 27, 1997 Page 7 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ADDRESSING THE ISSUE OF UNIONIZATION AND COLLECTIVE <br />BARGAINING IN THE SAN MARCOS POLICE DEPARTMENT; ENCOURAGING <br />SAN MARCOS RESIDENTS TO BECOME FULLY INFORMED AS TO THE <br />SERIOUS REPERCUSSIONS OF COLLECTIVE BARGAINING; AND DECLARING <br />AN EFFECTIVE DATE. <br />Mr. Guerra moved for adoption of the Resolution and Mr. Cox seconded the motion. Ralph <br />Merriweather stated he felt the Council should give the police an even playing field and should <br />support the police officers. He stated he feels the police officers are only asking for better wages <br />and benefits and feels the Council should remain neutral. Mr. Merriweather stated he has been a <br />union organizer for many years and encourages the Council not to object to the issue. Mr. <br />Mihalkanin moved to make the following amendments: To delete Part 4 and renumber the rest; <br />Part 8 to remove "rather than focusing on the employees of an individual department"; Part 9 to <br />remove "a vehicle replacement program, and upgrading of communications"; Part 11 to remove <br />"unjust to the citizens of San Marcos, and equitable to other City employees" and Ms. Hughson <br />seconded the motion. Mr. Mihalkanin stated he did not feel this was a unionization issue but <br />collective bargaining. Ms. Hughson stated some of this Resolution is inflammatory and has <br />concerns regarding some of the wording in the Resolution. Mayor Moore asked about the <br />vehicle replacement program. Mr. Gilley stated the vehicle replacement program is not based on <br />miles but wider factors including budget and maintenance records. On roll call for the <br />amendments the following vote was recorded: <br />AYE: Mihalkanin, Hughson, Hart, Cox. <br />NAY: Moore, Guerra, Hernandez. <br />ABSTAIN: None. <br />Motion passes. Mr. Mihalkanin moved to amend Part 13 to remove". . . serious. . .no on the <br />collective bargaining proposition" and Ms. Hughson seconded the motion. On roll call the <br />following vote was recorded: <br />AYE: Mihalkanin, Hughson, Moore, Cox. <br />NAY: Hart, Guerra, Hernandez. <br />ABSTAIN: None. <br />Motion passes. Mr. Hernandez asked if there is a federal prohibition against this issue. Mr. <br />Taylor stated no. Ms. Hughson moved to delete Part 12 entirely and renumber and Mr. <br />Mihalkanin seconded the motion. On roll call the following vote was recorded: <br />AYE: Mihalkanin, Hughson. <br />NAY: Hart, Moore, Guerra, Cox, Hernandez. <br />ABSTAIN: None. <br />Motion fails. On roll call for adoption of the Resolution the following vote was recorded: <br />AYE: Mihalkanin, Hart, Moore, Guerra, Cox. <br />NAY: Hughson, Hernandez. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration approval of Change Order No.2 in the amount of <br />$53,119.00 for the Wastewater Treatment Plant Expansion Project. Mr. Cox moved for approval <br />
