<br />158 <br />Regular Meeting October 27, 1997 Page 8 <br />of the Change Order and Ms. Hughson seconded the motion. Ms. Hughson asked why the City <br />was not aware a fence was needed in the beginning of this project. Mr. Gilley stated the property <br />was not being used in the same manner it is being used now, which property is to grow hay by <br />the Parks and Recreation Department. Mr. Jenkins stated that tract of land is also used for sludge <br />application and woodchips used for composting experiments. Mr. Guerra asked if Items 1-5 <br />were not anticipated. Mr. Gilley stated they were not anticipated. Mr. Guerra stated he would <br />like Cities all over Texas to be more prudent in anticipating these types of needs since they are <br />significant changes. Mr. Gilley stated it is the City's goal not to have change orders; however, <br />projects of this magnitude are hard to determine in the beginning stages. The Council then voted <br />unanimously for approval of Change Order No.2. <br />Mayor Moore introduced a discussion regarding the Veterans Memorial Committee to officially <br />designate the property at the corner of Riverside Drive and Hopkins Street as the site for the Hays <br />Veterans'Memoriai. Richard Cruz stated the Committee would like to know if the Council <br />would agree to designate this property for the site of this Memorial. Mr. Hart asked how the <br />plans are laid out and if this was going to take up the entire piece of property. Mr. Cruz stated <br />they do have a layout plan and it is approximately 1,500 square feet for the foundation. Mayor <br />Moore asked how this property was determined. Mr. Cruz stated they originally requested the <br />piece of property between the Activity Center and the New Library; however, there was no <br />positive response from the Library Board. Mr. Cruz stated they chose this property because of <br />the visibility of the location and children's activities on this project which would draw more <br />attention to the Memorial. Mr. Guerra asked if a parking lot was needed and if that would be <br />constructed by the River Corridor or if the City would pay for a parking lot. Mr. Cruz stated a <br />parking lot will not be constructed at this time. The consensus of the Council was to designate <br />the Memorial site at Riverside and Hopkins and present to the Council for approval at the next <br />meeting. <br />Mayor Moore introduced the City Manager's Report. Mr. Gilley had no report at this meeting. <br />Mayor Moore introduced the City Attorney's Report. Mr. Taylor had no report at this meeting. <br />Mayor Moore introduced the City Council's Report. 1) Ms. Hughson stated she attended the <br />Healthy Communities Luncheon and felt this was very successful. She requested the City <br />distribute the safety plans information in City Hall regarding domestic violence. 2) Mayor <br />Moore stated the Greater Austin-San Antonio Corridor Council has scheduled a Regional <br />Conference regarding regional issues and priorities to be held in San Marcos at the Activity <br />Center in March. Mayor Moore estimates this Conference will draw approximately 600 people <br />to San Marcos and asked the City for their complete support. 3) Mr. Cox stated he met with the <br />Community Task Force last week and they asked if the liability issues have been settled <br />regarding the bicycle trails. Mr. Gilley stated that issue has not been resolved because the City <br />has not been provided a plan which would have to be reviewed by our liability carrier. <br />Mayor Moore introduced an Executive Session pursuant to the Government Code, Section <br />551.071, to discuss pending litigation (Virginia Gonzales vs. City; Bernice Valdez vs. City). Mr. <br />Mihalkanin moved to adjourn into Executive Session at 11 :20 p.m. and Ms. Hughson seconded <br />the motion, which passed unanimously. (Mr. Hart and Mr. Hernandez not present on roll call). <br />Mr. Guerra moved to reconvene from Executive Session at 11 :20 p.m. and Ms. Hughson <br />seconded the motion. (Mr. Hart and Mr. Hernandez not present on roll call). <br />The meeting adjourned at 11 :21 p.m. on motion made by Mr. Mihalkanin and seconded by Mr. <br />Guerra.
