<br />46 <br /> <br /> <br /> <br />Special Meeting September 2, 1997 Page 2 <br /> <br /> <br />Ms. Hughson moved to amend to change the number of representatives <br />from the Hospitality Industry from two to three and Mr. Cox seconded <br />the motion. Mr. Cox then withdrew his second, and the motion <br />failed. Mr. Mihalkanin stated he thought there should just be one <br />representative from each group. Mayor Moore and Mr. Guerra both <br />thought the Board should have two Council Members. Mr. Mihalkanin <br />then moved to amend the Ordinance for the Board to have ten members <br />as follows: 1 Greater San Marcos Council of Neighborhood <br />Associations member, 2 Council Members, 1 Arts Community, 1 <br />Hospitality Industry, 1 Hotel Industry, 1 San Marcos Area Chamber of <br />Commerce, 1 San Marcos Hispanic Chamber of Commerce, 1 Heritage <br />Association and 1 Downtown Association, seven members must reside in <br />the City limits and no more than three members reside outside the <br />City limits, and Mr. Cox seconded the motion. On roll call the <br />following vote was recorded: <br /> <br />AYE: Mihalkanin, Hart, Moore, Guerra, Cox. <br /> <br />NAY: Hughson. <br /> <br />ABSTAIN: None. <br /> <br />The Council then voted unanimously for adoption of the Ordinance on <br />third and final reading (Ms. Hughson left the meeting at this time - <br />5:55 p.m.). <br /> <br />Mayor Moore introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 14, BUILDINGS AND BUILDING REGULATIONS, <br />OF THE SAN MARCOS CITY CODE, TQ PROVIDE ADDITIONAL TIME FOR <br />RENEWAL OF CITY MECHANICAL CONTRACTOR LICENSES; INCLUDING <br />PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Guerra moved for adoption of the Ordinance on emergency and Mr. <br />Mihalkanin seconded the motion, which passed unanimously. <br /> <br />Mayor Moore introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to discuss matters where the City <br />Attorney's ethical duty to the City clearly conflicts with <br />Government Code, Chapter 551, and contemplated litigation (surface <br />water reuse permit proceeding). Mr. Mihalkanin moved to adjourn <br />into Executive Session at 5:55 p.m. and Mr. Hart seconded the <br />motion, which passed unanimously. <br /> <br />Mr. Mihalkanin moved to reconvene at 6:45 p.m. and Mr. Hart seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Moore introduced for consideration approval to authorize legal <br />action by the City Attorney and McGinnis, Lockridge & Kilgore <br />related to the surface water reuse permit proceeding. Mr. Hart <br />moved to authorize legal action and Mr. Cox seconded the motion. On <br />roll call the following vote was recorded: <br /> <br />AYE: Hart, Moore, Cox. <br /> <br />NAY: Mihalkanin, Guerra. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. Mr. Mihalkanin moved to reconsider approval to <br />authorize legal action by the City Attorney and McGinnis, Lockridge <br />& Kilgore related to the surface water reuse permit proceeding and <br />Mr. Hart seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />AYE: Mihalkanin, Hart, Moore, Cox. <br /> <br />NAY: Guerra. <br /> <br />ABSTAIN: None. <br />
