96 <br />Regular Meeting September 22, 1997 Page 2 <br />Mayor Moore introduced for consideration a public hearing and adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING ORDINANCE 1997-17 TO MAKE CORRECTIONS TO THE <br />ZONING CHAPTER OF THE CITY CODE REGARDING THE REAR SETBACK <br />FOR C-2 HEAVY COMMERCIAL DISTRICTS; INCLUDING PROCEDURAL <br />PROVISIONS; PROVIDING FOR PENALTIES; AND DECLARING AN <br />EMERGENCY. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. There were no <br />speakers so Mayor Moore closed the public hearing. Mr. Hart moved for adoption of the <br />Ordinance on emergency and Mr. Mihalkanin seconded the motion. Mr. Cox remarked this <br />Ordinance was to correct an error made in April. The Council then voted unanimously for <br />adoption of the Ordinance on emergency. <br />Mayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1996-1997 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE MUNICIPAL AIRPORT FOR <br />THE 1998 EXPERIMENTAL AIRCRAFT ASSOCIATION FLY-IN AND DECLARING <br />AN EMERGENCY. <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Ms. Hughson seconded <br />the motion, which passed unanimously. <br />Mayor Moore introduced for consideration removal from the table and adoption of a Zoning <br />Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A ONE ACRE TRACT OF PROPERTY LOCATED AT 804 GRAVEL STREET FROM <br />"R-1" SINGLE-FAMILY RESIDENTIAL DISTRICT (LOW DENSITY) TO "MR" <br />MOBILE HOME AND RESIDENTIAL DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Ms. Hughson moved for adoption of the Ordinance and Mr. Hart seconded the motion. (Mr. <br />Guerra present at this time - 7:55 p.m.). Mr. Hernandez stated he was not in favor of this zoning <br />change if it was being used for rental property. He stated he felt it did not suit this neighborhood. <br />Mr. Theriot stated the "MR" District is required if the mobile home is not going to be in a mobile <br />home park. He stated the idea was to identify areas to concentrate on the "MR" District. Mr. <br />Taylor stated once the property is zoned "MR" the owners of the property could not be prevented <br />from renting the property. On roll call the following vote was recorded: <br />AYE: Mihalkanin, Moore, Guerra. <br />NAY: Hughson, Hart, Cox, Hernandez. <br />ABSTAIN: None. <br />Motion fails. <br />Mayor Moore introduced for consideration reconsideration of a Zoning Ordinance.
