AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING AN 8.18 ACRE TRACT OF PROPERTY LOCATED OFF OF THE 300 BLOCK OF WONDER WORLD DRIVE FROM "PD" PRE-DEVELOPMENT DISTRICT TO "I" INDUSTRIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING AN 18.39 ACRE TRACT OF PROPERTY LOCATED OFF OF THE 200 AND 300 BLOCKS OF WONDER WORLD DRIVE FROM "R-2" SINGLE-FAMILY RESIDENTIAL DISTRICT (MEDIUM DENSITY) TO "MF-4" MULTI-FAMILY DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Moore introduced for consideration the consent agenda including approval of the minutes of the Regular Meeting held August 25, 1997, approval of the minutes of the Special Meeting held September 2, 1997, approval of two Ordinances on second reading, adoption of two Ordinances on third and final reading, adoption of thirteen Resolutions, approval of Change Order No. 2 to the Blanco Street Paving and Drainage Project in the amount of $45,488.01 for deficiencies in the work by NBS Construction, Inc., approval of funding from the tourist account in the amount of $4,400.00 for weepuls, approval of funding from the tourist account in the amount of $3,215.50 for TML booth expenses and approval of funding from the tourist account in the amount of $1,405.00 for the City of San Marcos Hospitality Suite at the U.S. Hispanic Chamber of Commerce Conference on consensus. The Council removed Items 9.B.(2), approval of an Ordinance on second reading, Items 9.D.(5-11), adoption of Resolutions, Item 9.E., approval of Change Order No. 2 for the Blanco Street Paving and Drainage Project, and Items 9.F.(1-3), funding from the tourist account, to be considered separately. Mr. Guerra moved for approval of the minutes of the Regular Meeting held August 25, 1997, approval of the minutes of the Special Meeting held September 2, 1997 (Mr. Hernandez abstaining), approval of an Ordinance on second reading, adoption of two Ordinances on third and final reading and adoption of the six remaining Resolutions on consensus. Mr. Mihalkanin seconded the motion, which passed unanimously. (Ms. Hughson abstaining on Item 9.D.(13) and Mr. Hernandez abstaining on Item 9.A.(2)}. The captions to these Ordinances and Resolutions read as follows: Approval of Ordinance on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 114.022 OF THE ZONING CHAPTER OF THE CITY CODE TO REQUIRE THE POSTING OF NOTIFICATION SIGNS ON PROPERTY PROPOSED FOR A ZONING CHANGE, ZONING VARIANCE OR SPECIAL USE PERMIT; AMENDING SECTION 114.025 OF THE ZONING CHAPTER OF THE CITY CODE TO PROVIDE THAT THE EXTRAORDINARY MAJORITY VOTE REQUIREMENT ONLY APPLIES TO CITY COUNCIL DECISIONS TO OVERRULE RECOMMENDATIONS FOR DENIAL OF ZONING CHANGES BY THE PLANNING AND ZONING COMMISSION; AMENDING SECTION 114.577 OF THE ZONING CHAPTER OF THE CITY CODE TO PROVIDE ONE-YEAR AND TWO-YEAR TERMS FOR HOME OCCUPATION SPECIFIC USE PERMI'T'S; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Adoption of Ordinances on third and final reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE 2, MASTER PLAN, OF CHAPTER 102, PLANNING, OF THE CITY CODE TO ADD A SECTION 102.029 REGARDING THE ADOPTION
