Mr. Moore moved to reappoint Monica <br />Blackburn and reappoint Carol Allen and Mayor Morris moved to <br />reappoint Mayor Pro-Tem Mooney, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of two <br />appointments to the Human Development Commission. Mr. Mooney moved <br />to appoint Dee Dee Winfield and Mr. Guerra moved to appoint Cindy <br />Mendez, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />approval of an Ordinance on first reading, the caption which was <br />read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ADOPTING A NEW CITY CODE FOR THE CITY OF SAN MARCOS, <br />TEXAS, INCLUDING A REORGANIZATION OF THE CITY¡S ZONING <br />ORDINANCES¡ INCLUDING PROCEDURAL PROVISIONS¡ AND PROVIDING FOR <br />PENALTIES. <br /> <br />I <br />Mayor Morris opened the public hearing and asked if anyone wished to I <br />speak. Mr. Taylor advised he has worked with the Code publisher for I <br />the past year and thinks this is a good product and will be more -- <br />easily understood with an easier<format. No one wished to speak at <br />the public hearing, so Mayor Morris closed the public hearing. Mr. <br />Moore moved for approval of the Ordinance on first reading and Mr. <br />Mooney seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an Annexation <br />Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS¡ <br />TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 35.09 <br />ACRES, MORE OR LESS, FRONTING ON THE NORTHWEST RIGHT-OF-WAY <br />LINE OF THE 4200 BLOCK OF IH-35 SOUTH IN HAYS COUNTY¡ TEXAS <br />(LOWMAN RANCH PROPERTY), THIS LAND BEING LOCATED WITHIN THE <br />EXTRATERRITORIAL JURISDICTION OF THE CITY AND ADJACENT TO <br />PRESENT CITY BOUNDARIES¡ APPROVING A SERVICE PLAN FOR THIS <br />TRACT; PROVIDING FOR PUBLICATION AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Mooney seconded the motion. Al Lowman, a general partner in a <br />family partnership of this property¡ advised the Council he was ¡' <br />withdrawing his request for annexation. The water supplier, Elim, <br />wants the developer to pay their federal taxes for this capital ¡ <br />investment, which is a new ruling allowance by TNRCC. Mr. Lowman -~ <br />requested (1) the City take a leadership role to take control of the <br />water situation, (2) the City assist with funding mandates they <br />impose, (3) the City table the annexation proceedings, and (4) a <br />meeting be arranged with the Mayor¡ City Manager, City Attorney, Mr. <br />Lowman and his family's lawyer to see if any options remain.
