3 <br />Regular Meeting October 14, 1996 Page 3 <br />Mayor Moore moved to reappoint Greg Davis, John Holtermann and Merry FitzPatrick, which <br />passed unanimously. <br />Mayor Moore introduced for consideration approval of a board appointment to the Central Texas <br />Library System Lay Representative. Mayor Moore moved to reappoint Nina PryateI, which <br />passed unanimously. <br />Mayor b Poore introduced for consideration confirmation of the City Manager's appointment to the <br />Civil Service Commission. Mr. Gilley recommended reappointment of Chris Luna. Mayor Moore <br />moved to confirm reappointment of Chris Luna and Mr. Guerra seconded the motion, which <br />passed unanimously. <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning Ordinance, <br />the caption which was read as follows: <br />AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ANIENDING THE OFFICIAL ZONINTG MAP OF THE CITY BY REZONING <br />A 5.28 ACRE TRACT OF PROPERTY LOCATED N THE 1700 BLOCK OF RANCH <br />ROAD 12 FROM "C" COMMERCIAL DISTRICT TO " fig'-2" tiIULTI-FAMILY <br />DISTRICT MEDIUM DENSITY); NCLUDINTG PROCEDURAL, PROVISIONS; AND <br />PROVID NG FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. No one did, so <br />Mayor Moore closed the public hearing. Mr. Hernandez moved for adoption of the Ordinance <br />and ,&. Guerra seconded the motion. Mr. Guerra asked about the additional traffic this zoning <br />change would create. Mr. Patterson stated the Commission felt retail traffic would be more <br />detrimental than multi-family traffic. Mr. Guerra asked if Commissioner Kolb abstained because <br />she owned property on this street and if the reason for abstention needed to be noted in the <br />minutes. Mr. Taylor stated that would be good policy; however, it was not legally required. He <br />stated what was legally required where a conflict of interest occurs is the filing of an affidavit. <br />Mr. Guerra requested members of commissions note their reasons of abstention. Mayor Moore <br />asked about the traffic at Bishop and Ranch Road 12. Ms. Hughson suggested the Council add <br />this item to their workshop regarding transportation and ask the Texas Department of <br />Transportation if this intersection could be put on their list to add a left turn lane and left turn <br />signalization. The Council then voted unanimously for adoption of the Ordinance. <br />Mayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ATMENDNG THE CITY BUDGET ORDNANCE FOR THE 1996-1997 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE BLANCO STREET DR LINAGE <br />IMPROVEMENTS PROJECT AND DECLARING AN EMERGENCY. <br />tils. Hughson moved for adoption of the Ordinance on emergency and Mr. Mihalkanin seconded <br />the motion. Mr. Cox asked what the CIP funding was for. Mr. Gilley stated the CIP funding was <br />for street and drainage. Mr. Gilley explained CIP funds were fund balances left from completed <br />projects. Mr. Jenkins explained this project would put the drainage under the ground and replace <br />existing storm sewers that were failing. The Council then voted unanimously for adoption of the <br />Ordinance on emergency. <br />iMayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1996-1997 <br />FISCAL YEAR TO PROVIDE TEMPORARY TRANSFER OF FUNDING FOR THE <br />WASTEWATER TREATMENT PLANT EXPA`TSION PROJECT AND DECLARING <br />ANi EMERGENCY.
