5 <br />Regular Meeting October 14, 1996 Page 5 <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDNANCE FOR THE 1996-1997 <br />FISCAL YEAR TO PROVIDE FENDING FOR THE CENTERPOINT <br />TRAL Rt vUSSION MAIN PROJECT AND DECLARING Alit EMERGENCY. <br />Ms. Hughson moved for adoption of the Ordinance on emergency and Mr. 1NIihalkanin seconded <br />the motion. Mr. Hart asked if this would adversely affect any ongoing negotiations with this <br />company. Mr. Gilley stated this would not be part of the Elim System; however, it is being <br />designed so that it can be a part of that system or the existing system. The Council then voted <br />unanimously for adoption of the Ordinance. <br />Mayor Moore introduced for consideration approval of an Ordinance on first reading, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN '2%,IARCOS, <br />TEXAS, ANNEXNG TO THE CITY A TRACT OF LAND CONTAINING 430 <br />ACRES, MORE OR LESS, INCLUDING WILLOW CREEK ESTATES SECTION 3, <br />THE RIDGE AT WILLOW CREEK SECTION 2 AND CERTAIN UNDEVELOPED <br />AREAS ALONG PURGATORY CREEK GENERALLY LOCATED BETWEEN THE <br />WESTOVER ADDITION AND WILLOW CREEK ESTATES; APPROVING A <br />SERVICE PLAN FOR THIS TRACT; PROVIDING FOR PUBLICATION AND <br />DECLARING AN EFFECTIVE DATE. <br />(GIs. Hughson abstaining on the preceding Ordinance and filed an Affidavit of Disclosure). <br />Mr. Cox moved for approval of the Ordinance on first reading and Mr. Hernandez seconded the <br />motion. Mayor Moore stated two public hearings have already been held on this issue; however <br />he would allow people to speak on this item. C.C. Laidley stated he owned 100 acres in this area <br />and 40% of this land is in the floodplain. Mr. Laidley stated he did not feel he should have to pay <br />taxes on land he could not develop. Mr. Hart questioned where the 40% of land in the floodplain <br />existed. Mr. Laidley explained the area was along the bed of Purgatory Creek. Mr. Hart asked if <br />he had been compensated for the floodplain area. Mr. Laidley stated that was correct because it <br />was state law referred to as an inundation easement. Mr. Stanley Hughson stated the residents in <br />the Ridge realize a transition needs to be made; however, you have to drive through other <br />subdivisions to enter the Ridge Section 2 and they are not being considered for annexation. Mr. <br />Hughson stated spot annexing is not fair for residents involved. Mr. Hart stated he agreed this <br />was not the proper way to develop orderly growth. He stated the City should address the <br />residents and show them this is the service plan and this is what we can do for you. Mr. Guerra <br />stated TNIL has released a study that Cities need to be aware of leap frog annexing. He stated the <br />Council needs to be aware of zoning without logic and not annexing areas because of monitary <br />worth. Mayor Moore stated he did not feet the City was gerrymandering city limits. Mr. Cox <br />stated he felt the city had the right to extend the city limit boundaries. Mr. Guerra agreed as long <br />as we exercise an appropriate right. Mr. Hughson stated he felt the city was leap frog annexing. <br />Mr. Patterson stated the reason for the configuration was the early development of Willow Creek <br />and standards for building the roads at that time. He stated it was also the ability to provide water <br />to that area. Mr. Patterson suggested the targeting of the new section was to bring city standards <br />to that area that have been set forth by the state in the floodplain along Purgatory Creek. <br />Discussion ensued. Mayor Moore explained residential development never pays for itself and the <br />benefits of annexation are enfranchisement, which means people who have their kids in school <br />here or own a business in town, have a voice. Mr. Hart asked the Council what they considered <br />orderly growth to mean. iMr. Gilley stated the City has followed the annexation process that has <br />been traditional of the City. He agreed there are other options or processes; however, the <br />annexation presented has followed the requirements of the state's standard annexation plans.
