6 <br />Regular Meeting October 14, 19-96 Page 6 <br />supported the additional cost benefits associated with that process. Mr. Mihalkanin stated this <br />proposal is in the context of the Master Plan; however, all the people in the area should be <br />contacted in advance that the issue would be discussed. On roll call the following vote was <br />recorded: <br />AYE: NIihalkanin, Moore, Cox, Hernandez. <br />NAY: Hart, Guerra. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration approval of an Ordinance on second reading, the <br />caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN TIARCOS, <br />TEXAS, EXTENDING THE HOURS FOR THE ON-PRE_-LV1ISE SALE OF MIXED <br />BEVERAGES AND BEER IN THE CITY FOR A TRIAL PERIOD BEGINNING <br />NOVEMBER 8, 1996 AND ENDING MAY 8, 1997; NCLUDING PROCEDURAL <br />PROVISIONS AND PROVIDING FOR PENALTIES. <br />Mr. Guerra moved to deny the Ordinance and Mr. Cox seconded the motion. Jack Chaney stated <br />he chose San Marcos because it is a beautiful town, unlike the big cities and asked the Council to <br />keep it that way. David Dishman, of the Draft Choice, hopes the Council votes on facts and not <br />emotions. Patty Sullivan stated this town has come a long way from being a party school and <br />asked the Council not to go back to that image. James Hernandez, Association of Student <br />Government at SWT, read a Resolution of support of the extended bar hours adopted by the <br />students at SWT. Rose Brooks stated she opposed the bar hours. Wes Austin stated he opposed <br />the extended bar hours. Leslie Goodman stated she opposed the bar hours. Tom McNair stated <br />he did not want the Council to encourage the citizens to do more drinking and asked the Council <br />to vote no on the bar hours. Mayor Moore stated this issue has been discussed for 12 years and - <br />you can't legislate morality and you can't stop the problem; however, this is an extremely difficult <br />situation. Mayor Moore explained he would like to get past this issue and a trial period would <br />give the City facts to finalize the future of this issue. Mr. Cox stated he disagreed with the <br />Mayor, respectively; however, drinking is a problem industry and should be regulated for public <br />safety. Mr. Hernandez asked for clarification why this issue had not been put on the ballot. Mr. <br />Taylor explained State Law allows for the Council to extend bar hours; however, it could be put <br />on the ballot as a non-binding referendum. Mr. Guerra stated this has become an emotional issue <br />and hoped the citizens could continue to trust in San Marcos. Ms. Hughson stated this was not a <br />referendum on alcohol, because alcohol is sold in grocery stores, liquor stores, convenience <br />stores, etc. She stated the issue presented is where do you want the drinking controlled, in the <br />neighborhoods or in a controlled environment. She stated she opposed a permanent 2 a.m. law; <br />however, she felt the extended hours would be on Thursdays, Fridays and Saturdays, and needed <br />some measurements to make a permanent position. Mr. Mihalkanin agreed the issue is between a <br />controlled or uncontrolled situation. He stated he would like to see a non-binding referendum on <br />the ballot in May. On roll call the following vote was recorded: <br />AYE: Hart, Guerra, Cox, Hernandez. <br />NAY: Mihalkanin, Hughson, Moore. <br />ABSTAIN: None. <br />The motion to deny the Ordinance passed, and it was consensus of the Council not to put the <br />issue on the ballot in May. <br />Mayor Moore introduced for consideration reconsideration of two Zoning Ordinances. The <br />Council did not wish to reconsider these Ordinances. The captions read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
